【摘要】：為推進(jìn)對西藏民事習(xí)慣的甄別和研究,形成國家法與西藏民事習(xí)慣的良好互動(dòng),推動(dòng)國家法的統(tǒng)一適用,文章從歷史法制研究、基礎(chǔ)理論研究、專題研究三個(gè)維度歸納分析了西藏民事習(xí)慣的研究現(xiàn)狀,從中反思,認(rèn)為存在基礎(chǔ)概念模糊、重歷史輕現(xiàn)實(shí)、突出整體性忽略特殊性三大問題,明確指出民事習(xí)慣法是國家通過一定方式賦予了民事習(xí)慣以國家強(qiáng)制力的國家法。以西藏目前仍然存在的民事習(xí)慣作為調(diào)查研究的新起點(diǎn),且以各因素類似的小區(qū)域?yàn)閱卧M(jìn)行民事制度整體調(diào)查,以此彌補(bǔ)當(dāng)前西藏民事習(xí)慣調(diào)查研究的不足。
[Abstract]:In order to promote the screening and study of Tibetan civil customs, to form a good interaction between the state law and the Tibetan civil custom, and to promote the unified application of the national law, this article focuses on the study of the historical legal system and the basic theory. This paper summarizes and analyzes the current research situation of Tibetan civil custom from three dimensions of special research, and thinks that there are three major problems: the basic concept is vague, the history is important, the reality is neglected, and the particularity is neglected. It is clearly pointed out that civil customary law is the national law that the state enacts civil custom with national compulsion in a certain way. Taking the existing civil custom in Tibet as the new starting point and taking the small area with similar factors as the unit to investigate the civil system as a whole, this paper makes up for the deficiency of the current civil custom investigation in Tibet.
