【摘要】：恢復(fù)性司法符合寬嚴(yán)相濟(jì)的刑事政策,順應(yīng)構(gòu)建和諧社會(huì)秩序的潮流,在保護(hù)被害人權(quán)益、犯罪人改過自新、提高訴訟效率等方面有巨大的價(jià)值。近親屬間犯罪因其天然的血緣關(guān)系、倫理道德基礎(chǔ),更加適合恢復(fù)性司法的運(yùn)用。為此,檢察機(jī)關(guān)應(yīng)當(dāng)通過擴(kuò)大不起訴適用范圍、規(guī)范司法行為等途徑,逐步推進(jìn)恢復(fù)性司法的適用。
[Abstract]:Restorative justice is in line with the criminal policy of combining leniency and severity with the trend of building a harmonious social order. It has great value in protecting the rights and interests of the victims, reforming the offenders and improving the efficiency of litigation. Because of its natural blood relationship and ethical and moral basis, the crime between close relatives is more suitable for the application of restorative justice. Therefore, procuratorial organs should promote the application of restorative justice step by expanding the scope of application of non-prosecution and standardizing judicial behavior.
