【摘要】:正英國(guó)政治哲學(xué)家哈耶克在論述"規(guī)則與正義的關(guān)系"時(shí)說(shuō):"所謂正義,始終意味著某個(gè)人或某些人應(yīng)當(dāng)或不應(yīng)當(dāng)采取某種行動(dòng);而這種所謂的‘應(yīng)當(dāng)’反過(guò)來(lái)預(yù)設(shè)了對(duì)某些規(guī)則的承認(rèn):這些規(guī)則界定了一系列情勢(shì),而在這些情勢(shì)中,某種特定的行為是被禁止的,或者是被要求采取的。"正因?yàn)槿绱?我們相信,法律的存在是為了永恒的正義。但是,這并非意味著正義總能恰當(dāng)?shù)亍?zhǔn)
