【摘要】：民間習(xí)慣法規(guī)則的研究從上世紀(jì)八十年代開始盛行,以蘇力先生反對(duì)一味的移植西方法律開始,作為本土資源的民間法研究開始進(jìn)入法學(xué)家的視野。法治建設(shè)是一項(xiàng)艱巨浩大的工程,這不僅需要法學(xué)專家們潛心學(xué)習(xí)國(guó)外先進(jìn)法治思想、立法技術(shù)、法律條文,還需要法學(xué)家結(jié)合我國(guó)本土情況,理解民意,表達(dá)民意,體現(xiàn)民意。如果只是在封閉空間,與書本為伴,那么創(chuàng)作出的法律條文是機(jī)械生硬的,只有走出去,在考察民情中,在生活體驗(yàn)中創(chuàng)造出的法律才是自主的靈動(dòng)的法律。因此把民間習(xí)慣法規(guī)則納入到立法、司法領(lǐng)域中加以運(yùn)用,這是不可阻擋的趨勢(shì)。本文首先介紹民間習(xí)慣法規(guī)則的概述,從概念特征、民間習(xí)慣法規(guī)則的歷史幾個(gè)方面對(duì)民間習(xí)慣法規(guī)則進(jìn)行總體性的介紹。然后介紹民間習(xí)慣法規(guī)則運(yùn)用的意義,闡釋民間習(xí)慣法規(guī)則有哪些作用。接著闡述在運(yùn)用民間習(xí)慣法規(guī)則有哪些難題需要我們?nèi)ソ鉀Q。突出部分是民間習(xí)慣法規(guī)則運(yùn)用的理論基礎(chǔ),借用哈特的規(guī)則結(jié)構(gòu)理論架起民間習(xí)慣法規(guī)則與國(guó)家法之間的橋梁。最后,回歸到實(shí)踐中立法、司法如何運(yùn)用民間習(xí)慣法規(guī)則的方式方法。
[Abstract]:The study of the rules of folk customary law began to prevail in the eighties of the last century, and the study of folk law, as a native resource, began to enter the field of view of jurists when Mr. Su Li opposed blindly transplanting western law. The construction of the rule of law is a formidable project, which not only requires legal experts to concentrate on learning advanced legal thoughts, legislative techniques and legal provisions from abroad, but also requires jurists to understand public opinion and express public opinion in the light of the local situation in our country. Reflect public opinion. If only in the closed space, with books, then the legal provisions are mechanical stiff, only go out, in the study of the people, in the life experience of the creation of the law is the autonomous smart law. Therefore, it is an irresistible trend to incorporate the rules of folk customary law into the field of legislation and judicature. This paper first introduces the outline of folk customary law rules, from the concept characteristics, folk customary law rules history of several aspects of the general introduction of folk customary law rules. Then it introduces the meaning of folk customary law rules and explains the role of folk customary law rules. Then it explains what problems need to be solved in the application of folk customary law rules. The prominent part is the theoretical basis for the application of the rules of folk customary law, and uses Hart's theory of rule structure to build a bridge between the rules of folk customary law and the state law. Finally, return to the practice of legislation, how to use the rules of folk customary law ways and means.
