【摘要】：全面推進(jìn)依法治國(guó),良法是善治的前提。以功利主義為視角重新檢討法律價(jià)值(公平與秩序)這一法理學(xué)基本命題,具有理論與實(shí)踐的雙重意義。公平要素基于正當(dāng)性證明命題、共同體的正義命題、功利主義原理而展開,秩序要素依賴法律實(shí)證主義基本命題來表達(dá)。公平與秩序通過自然法層面的"分"與"合"揭示了法律價(jià)值的內(nèi)在意蘊(yùn)。秩序要素所涵攝的法律實(shí)用性問題在功利主義的指引下演化為法律與社會(huì)的關(guān)系問題,利益法學(xué)的引入則實(shí)現(xiàn)了法律價(jià)值與功利主義的對(duì)接,從而拓展了法律價(jià)值的研究思路。
[Abstract]:To comprehensively promote the rule of law, good law is the premise of good governance. It is of both theoretical and practical significance to review the legal value (fairness and order) as a basic proposition of jurisprudence from the perspective of utilitarianism. The elements of fairness are based on the propositions of justification, justice of the community, and utilitarianism, and the elements of order are expressed by the basic propositions of legal positivism. Fairness and order reveal the inner meaning of legal value through the "division" and "combination" of natural law. Under the guidance of utilitarianism, the legal practicability of order elements has evolved into the relationship between law and society, and the introduction of interest jurisprudence has realized the docking of legal value and utilitarianism, thus expanding the research ideas of legal value.
