【摘要】：訴訟是西方社會(huì)運(yùn)動(dòng)重要的維權(quán)策略,在西方社會(huì)運(yùn)動(dòng)中扮演著重要角色。西方社會(huì)運(yùn)動(dòng)訴訟維權(quán)研究主要沿著兩條路徑進(jìn)行:一條是"權(quán)利神話";另一條是"象征的或策略的",在這兩條不同路徑的統(tǒng)攝下,研究者得出了截然相反的結(jié)論。本文首先回顧了西方社會(huì)運(yùn)動(dòng)訴訟維權(quán)研究圍繞著訴訟本身及其結(jié)果與訴訟中律師的角色產(chǎn)生的爭(zhēng)論;其次,本文回顧了西方社會(huì)運(yùn)動(dòng)訴訟維權(quán)的法律機(jī)會(huì)結(jié)構(gòu)研究;最后,本文指出,隨著中國(guó)抗?fàn)幷卧絹?lái)越多地走上法庭,學(xué)術(shù)界雖然開(kāi)始關(guān)注抗?fàn)幷沃械脑V訟維權(quán),但是目前的研究還缺乏系統(tǒng)的理論支持,而西方社會(huì)運(yùn)動(dòng)訴訟維權(quán)研究能夠?yàn)槲覀兲峁├碚撡Y源。
[Abstract]:Litigation is an important strategy of western social movement and plays an important role in western social movement. The study of litigation rights in western social movements mainly follows two paths: one is "myth of rights" and the other is "symbolic or strategic". Under the control of these two different paths, the researcher has reached a conclusion of the opposite. This paper first reviews the western social movement litigation rights research around the litigation itself and its results and the role of lawyers in litigation disputes; secondly, this article reviews the western social movement litigation rights legal opportunity structure research; finally, This paper points out that with more and more Chinese protest politics going to court, although academic circles begin to pay attention to litigation rights in protest politics, the current research lacks systematic theoretical support. Western social movement litigation rights research can provide us with theoretical resources.
