【摘要】：法定許可制度是著作權(quán)限制制度的重要組成部分,是指根據(jù)法律的直接規(guī)定,以特定的方式使用已經(jīng)發(fā)表的作品,可以不經(jīng)著作權(quán)人的認(rèn)可,但應(yīng)向著作權(quán)人支付使用費(fèi)的制度。法定許可制度是著作權(quán)人、被許可人和公共利益的平衡器,力圖既能保護(hù)著作權(quán)人,又能激勵(lì)文化創(chuàng)新,同時(shí)又可以維護(hù)公眾獲取信息的權(quán)利。美國(guó)的知識(shí)產(chǎn)權(quán)限制制度比較成熟,是強(qiáng)制許可制度(法定許可制度)的發(fā)源國(guó),本文通過(guò)對(duì)美國(guó)強(qiáng)制許可制度的歷史淵源探究和適用范圍以及美國(guó)本國(guó)內(nèi)對(duì)此制度的討論,進(jìn)一步探尋美國(guó)強(qiáng)制許可制度。我國(guó)法定許可制度已初步建立,并有獨(dú)特的報(bào)刊轉(zhuǎn)載、摘篇法定許可制度以及“聲明保留權(quán)”制度,但在法定許可范圍、付酬標(biāo)準(zhǔn)、付酬程序等問(wèn)題上仍然存在缺陷,特別針對(duì)在網(wǎng)絡(luò)環(huán)境下的新問(wèn)題,就需要全面研究美國(guó)的權(quán)利限制體系以及在實(shí)際操作過(guò)程中的程序問(wèn)題,通過(guò)對(duì)兩國(guó)的法定許可制度進(jìn)行比較法研究,探求不同法律傳統(tǒng)下的法定許可制度的異同,參考其成功的立法經(jīng)驗(yàn)和司法實(shí)踐,提出完善制度建議。
[Abstract]:The legal license system is an important part of the copyright restriction system. It refers to the use of published works in a specific manner in accordance with the direct provisions of the law, without the approval of the copyright owner. However, the system of payment of royalties to copyright owners. Legal license system is a balance between copyright owner, licensee and public interest. It can not only protect copyright owner, but also stimulate cultural innovation, and at the same time protect the public's right to obtain information. The intellectual property restriction system of the United States is quite mature, and it is the country of origin of the compulsory licensing system (statutory licensing system). This paper probes into the historical origin and the scope of application of the compulsory licensing system in the United States and discusses the system in the United States. Further explore the United States compulsory licensing system. The legal license system of our country has been preliminarily established, and has been reproduced in special newspapers and periodicals, and the system of legal permission as well as the system of "declaring the right to reserve" has been reproduced. However, there are still some defects in the scope of legal permission, the standard of payment, the procedure of payment, and so on. Especially in view of the new problems in the network environment, it is necessary to comprehensively study the rights limitation system in the United States and the procedural issues in the actual operation process, through the comparative study of the legal licensing system of the two countries. This paper probes into the similarities and differences of the legal permission system under different legal traditions, and puts forward some suggestions for perfecting the system by referring to its successful legislative experience and judicial practice.
