【摘要】：上海公共租界會審公廨是西方列強侵奪中國司法權的工具之一。L海租界開辟后,在上海公共租界先后成立了洋涇浜北首歷史衙門、會審公廨、臨時法院和特區(qū)法院四個司法審判機構。上海公共租界會審公廨的司法權歸屬一直是中外雙方爭奪的重點。本文以上海公共租界會審公廨的演變發(fā)展為線索,在敘述上海會審公廨司法權的產生及其不同時期的發(fā)展狀況的基礎上,通過解讀中外雙方所簽章程、條約、換文等,著重研究了其司法權的發(fā)展及雙方對于這類機構司法權的爭奪,闡明會審公廨司法權的收回歷程。 本文首先對上海公共租界會審公廨的司法權做出界定,隨后介紹會審公廨司法權的產生及運行狀況。在此基礎之上,本文將司法權的收回過程以其承載體的演變?yōu)闃藴蕜澐譃槿齻�階段：辛亥革命后的會審公廨司法權的復位努力、后會審公廨即臨時法院司法權歸屬的角力以及特區(qū)法院司法權的收回努力。本文第二、三、四部分分別對以上三個階段作出闡述,主要介紹了在各個時期會審公廨司法權的運行背景、運行狀況及其收回歷程。
[Abstract]:After the opening of the Shanghai Public concession Court, one of the tools used by Western powers to encroach on China's judicial power, the Shanghai Public concession has successively established the Pidgin Northern first Historical Yamen, and the mixed Court. The Provisional Court and the District Court have four judicial organs. The jurisdiction of the mixed Court of Shanghai Public concession Court has always been the focus of contention between Chinese and foreign sides. This paper takes the evolution and development of the mixed Court of Shanghai Public concession as a clue, on the basis of narrating the emergence of the judicial power of the mixed Court and its development in different periods, by interpreting the articles of association, treaties and exchange of letters signed by both Chinese and foreign sides. This paper focuses on the development of judicial power and the competition between the two sides for the judicial power of such institutions, and expounds the recovery process of the judicial power of the mixed Court. This paper first defines the judicial power of the mixed Court of Shanghai Public concession, and then introduces the emergence and operation of the mixed Court. On this basis, the process of judicial power recovery is divided into three stages according to the evolution of its bearer: the restoration of the judicial power of the mixed Court after the Revolution of 1911. The judicial power of the Provisional Court and the recovery of the judicial power of the SAR Court. In the second, third and fourth parts, the author expounds the above three stages, mainly introduces the operating background, the operating condition and the recovery process of the judicial power of the mixed Court in each period.
