信息、信任與規(guī)制性競(jìng)爭(zhēng)——網(wǎng)絡(luò)社會(huì)中二手房交易之信息傳遞

【摘要】:中國(guó)房地產(chǎn)中介領(lǐng)域以及其他網(wǎng)絡(luò)交易領(lǐng)域,正遭遇信任喪失的危機(jī),虛擬市場(chǎng)充斥著虛假不實(shí)的交易信息。任其發(fā)展,對(duì)電子化網(wǎng)絡(luò)系統(tǒng)的影響是毀滅性的,有必要進(jìn)行國(guó)家干預(yù)。管制性競(jìng)爭(zhēng)對(duì)凈化二手房交易市場(chǎng)信息披露機(jī)制具有重要意義。既往的研究多將規(guī)制理解為一種"強(qiáng)制",較多運(yùn)用禁止性、限制性、壓迫性等"否定性措施"進(jìn)行規(guī)制,容易忽略規(guī)制其實(shí)還有其積極的一面——規(guī)制性競(jìng)爭(zhēng)。規(guī)制性競(jìng)爭(zhēng)是結(jié)合私法手段和公共權(quán)力資源改造競(jìng)爭(zhēng)市場(chǎng)的一種極為重要的方法。政府或者其他公共權(quán)力機(jī)構(gòu)借助公共資源參與規(guī)制性競(jìng)爭(zhēng),不僅可以壓迫私人企業(yè)約束其不正當(dāng)競(jìng)爭(zhēng)行為,達(dá)到規(guī)制目的,還可迅速凈化市場(chǎng),取得市場(chǎng)效率。二手房網(wǎng)絡(luò)房源信息混亂的現(xiàn)象,可以通過(guò)讓政府房產(chǎn)信息平臺(tái)參與規(guī)制性競(jìng)爭(zhēng)的方式得到治理。規(guī)制性競(jìng)爭(zhēng)表明,政府的權(quán)力不僅僅在于強(qiáng)制性地維護(hù)一個(gè)健康的市場(chǎng)(例如,遏制不正當(dāng)競(jìng)爭(zhēng)、壟斷現(xiàn)象),還在于當(dāng)良性的競(jìng)爭(zhēng)性市場(chǎng)不存在、且難以透過(guò)私人力量迅速形成的時(shí)候,政府可以也應(yīng)當(dāng)透過(guò)優(yōu)勢(shì)的公共資源、按照競(jìng)爭(zhēng)規(guī)則去組建(形成)一個(gè)競(jìng)爭(zhēng)性市場(chǎng),通過(guò)自己參與競(jìng)爭(zhēng)來(lái)傳達(dá)競(jìng)爭(zhēng)的規(guī)則,達(dá)到形成市場(chǎng)的功能——此為規(guī)制性競(jìng)爭(zhēng)最為本質(zhì)的內(nèi)涵。
[Abstract]:China's real estate agency sector and other online transactions are suffering from a crisis of trust, and virtual markets are flooded with false and unreal trading information. Let it develop, the impact on the electronic network system is devastating, there is a need for state intervention. Regulatory competition is of great significance in purifying the information disclosure mechanism in the second-hand housing market. Previous studies have interpreted regulation as a kind of "compulsion" and used more "negative measures" such as prohibition, restriction and oppression to regulate, and it is easy to ignore that regulation has its positive side-regulatory competition. Regulatory competition is a very important way to reform the competitive market by combining private law and public power resources. The government or other public power institutions participate in regulatory competition with the help of public resources, which not only can suppress private enterprises to restrain their unfair competition, but also can quickly purify the market and obtain market efficiency. The phenomenon of second-hand housing network source information confusion can be managed by letting the government housing information platform participate in regulatory competition. Regulatory competition shows that the power of government lies not only in the compulsory maintenance of a healthy market (for example, curbing unfair competition, monopolistic phenomena, but also in the absence of a benign competitive market). And when it is difficult to form rapidly through private forces, governments can and should form (form) a competitive market according to competition rules through superior public resources, and communicate the rules of competition through their own participation in competition. To achieve the function of forming market-this is the most essential connotation of regulatory competition.
