【摘要】：魁北克，作為當(dāng)今混合法域的主要代表地區(qū)之一，其民事訴訟法被稱作“三種文化的融合體”。這種融合主要表現(xiàn)在：歷史維度上，受法國與英國兩個國家法律傳統(tǒng)的影響深刻，地緣層面上，近代對美國等法治發(fā)達(dá)國家的借鑒與參照�？笨说拿袷略V訟法起源于新法蘭西時期的法國民事訴訟敕令，這一敕令即使是在魁北克淪為英國殖民地后，仍在相當(dāng)長的時間內(nèi)被援引。這種“親法疏英”的傳統(tǒng)也深刻影響了19世紀(jì)中期魁北克的法律編纂活動。直到1866年，第一部魁北克民事訴訟法典才正式頒布。該法典與同年頒布的《魁北克民法典》一起構(gòu)成了加拿大“一國兩法”的法律體系。在加拿大，除魁北克外其他省都通行普通法。而在魁北克省，雖然公法領(lǐng)域基本適用普通法，卻存在一部大陸法系特征鮮明的民法典。正是在此法律環(huán)境下，魁北克民事訴訟法典先后經(jīng)歷了三次重要的修訂。與1866年法典相比，現(xiàn)如今的民事法典已發(fā)生了徹底的變化，但其混合法的特征卻仍舊得到了保留。
[Abstract]:Quebec, as one of the main representative regions of modern mixed jurisdiction, its civil procedure law is called "the fusion of three cultures". This kind of fusion mainly manifests in: the historical dimension, by France and England two countries legal tradition influence deeply, in the geographical aspect, the modern times to the United States and so on rule of law developed country's reference and the reference. Quebec's civil procedure law originates from the French civil procedure decree of New France, which was invoked for quite a long time even after Quebec became a British colony. This tradition of pro-French and anti-English also influenced Quebec's law compilation in the mid-19th century. It was not until 1866 that the first Quebec Code of Civil procedure was promulgated. The Code, together with the Quebec Civil Code of the same year, constituted the legal system of Canada's "one country, two laws". In Canada, the common law is used in all provinces except Quebec. In Quebec, though the common law is basically applicable in the field of public law, there is a civil code with distinctive characteristics of the civil law system. It is in this legal environment that Quebec Code of Civil procedure has undergone three important revisions. Compared with the code of 1866, the civil code has completely changed, but the characteristics of its mixed law are still preserved.
