【摘要】："人大主導(dǎo)立法"是我國人民代表大會制度與社會主義立法體制的根本要求,也是立法獲得正當性與權(quán)威性的必然條件。觀察近40年的中國立法發(fā)展,一個顯著的事實就是,人大立法權(quán)、尤其是人民代表大會立法權(quán)的虛置弱化以及由此形成的立法過程中"人民形式上有權(quán)、實際上無權(quán)"的狀況。重塑當代中國立法的正當性基礎(chǔ)和公正性品質(zhì),尋求立法的民主性與科學(xué)性、立法效率與法律實效的協(xié)調(diào),必須從行動上回歸我國憲法法律文本的各項規(guī)定,維護有立法權(quán)的人大在立法過程中的主導(dǎo)地位。然而,由于人大立法能力的實然狀況以及諸多體制性制約因素,追求"人大主導(dǎo)立法"不能過于理想主義。有立法權(quán)的人大對立法過程的主導(dǎo)只能是逐步在具體層面、特定環(huán)節(jié)和一定限度內(nèi)實現(xiàn)。
[Abstract]:"National people's Congress leading legislation" is the basic requirement of the system of people's Congress and socialist legislative system of our country, and it is also the inevitable condition for the legitimacy and authority of legislation. Observing the development of Chinese legislation in the past 40 years, it is a remarkable fact that the legislative power of the people's Congress, especially the virtual weakening of the legislative power of the people's Congress, and the situation of "the people have the right in form but in fact have no power" in the legislative process. In order to rebuild the legitimacy foundation and fair quality of contemporary Chinese legislation, to seek the democratic and scientific nature of legislation, and to coordinate the efficiency of legislation with the actual effect of law, we must return to the provisions of the legal texts of our constitution from an action perspective. Maintain the leading position of the people's Congress with legislative power in the legislative process. However, due to the reality of the legislative capacity of the NPC and many institutional constraints, the pursuit of "NPC leading legislation" should not be too idealistic. The people's Congress with legislative power dominates the legislative process only gradually in the specific level, specific links and certain limits.
