【摘要】：法律論證型式是指在司法實(shí)踐中為解決法律沖突而使用的論證結(jié)構(gòu)或方法。就最具影響力而言,"于德水案"提供了一個(gè)法律論證型式示范性研究的典型案例,"于德水案"判決書(shū)的說(shuō)理論證,形成了當(dāng)下中國(guó)司法判決之善于說(shuō)理、敢于說(shuō)理的——"偉大的""標(biāo)桿性"判決書(shū)。該判決書(shū)自如地運(yùn)用了圖爾敏論證型式、跡象論證、根據(jù)歸類的論證、根據(jù)已確立規(guī)則的論證等多種法律論證型式,既從宏觀上呈現(xiàn)了該案主論證的型式結(jié)構(gòu)及其類型,又從微觀上對(duì)子論證進(jìn)行了適當(dāng)、有效的型式分析。作為標(biāo)桿性案例(或指導(dǎo)性案例),其對(duì)法律論證型式適用的形式性、合理性、可接受性、完整性、多樣性、充分性、機(jī)應(yīng)性以及靈活性,示范出當(dāng)代中國(guó)刑事司法判決的說(shuō)理論證之內(nèi)在邏輯張力,從而也展現(xiàn)出典型性、普遍性和指導(dǎo)性的意義。
[Abstract]:The pattern of legal argumentation refers to the argumentation structure or method used to resolve the conflict of laws in judicial practice. As far as the most influential aspect is concerned, "Yu de Shui case" provides a typical case of the model study of legal argumentation, and the reasoning argument of the judgment of "Yu de Shui case" forms the current Chinese judicial judgment good reasoning. Dare to reason-"great" and "benchmarking" judgment. In this judgment, Tourmin's argumentation type, the sign argument, the classification argument, the established rules and other legal argumentation types are used freely, which presents the type structure and types of the main argumentation in this case macroscopically. From the micro point of view, a proper and effective type analysis of the sub-argument is carried out. As a benchmarking case (or a guiding case), its applicability to legal argumentation is formal, reasonable, acceptable, complete, diverse, adequate, responsive and flexible, It demonstrates the internal logical tension of the reasoning and argumentation of the contemporary Chinese criminal judicial judgment, thus showing the typical, universal and instructive significance.
