【摘要】：地理學(xué)思維和方法已經(jīng)在經(jīng)濟(jì)學(xué)、語(yǔ)言學(xué)、社會(huì)學(xué)等學(xué)科領(lǐng)域得到廣泛應(yīng)用,但在法學(xué)研究中仍鮮有體系性和系統(tǒng)性闡述。法律在客觀上所具有的地理性特征,以及法學(xué)理論研究中所包含的大量地理學(xué)思維為我們構(gòu)建法律地理學(xué)提供了理論基礎(chǔ)。如果運(yùn)用地理學(xué)方法研究法律,那么法律會(huì)呈現(xiàn)出空間分布、系統(tǒng)性并呈耗散結(jié)構(gòu)。"法律熵"的值將是研究法律系統(tǒng)之耗散結(jié)構(gòu)的量化工具。每個(gè)法律系統(tǒng)中所包含的法律規(guī)范、法律概念、法律原則等法律要素與其他法律系統(tǒng)之間的交往程度及其穩(wěn)定性(即耗散程度)都可以用該值來(lái)衡量。如果從外在系統(tǒng)中輸入的法律各要素使得本系統(tǒng)的無(wú)序性得到改善,那么輸入的就是負(fù)熵,反之則是正熵。要描述一個(gè)法律系統(tǒng)的當(dāng)前狀態(tài)及其歷史演化,我們需要做的便是觀察熵值的變化及其過(guò)程。
[Abstract]:Geography thinking and methods have been widely used in economics, linguistics, sociology and other disciplines, but there are few systematic and systematic elaboration in the study of law. The geographical characteristics of law objectively and a large number of geographical thinking contained in the study of legal theory provide a theoretical basis for us to construct legal geography. If law is studied with a geographical approach, it will be spatially distributed, systematic and dissipative. " The value of law entropy will be a quantitative tool for studying the dissipative structure of legal system. The degree of interaction and stability (i.e. dissipative degree) between the legal elements such as legal norms, legal concepts, legal principles and other legal systems can be measured in each legal system. If the law elements input from the external system improve the disorder of the system, then the input is negative entropy, otherwise it is positive entropy. To describe the current state and historical evolution of a legal system, we need to observe the change of entropy and its process.
