【摘要】：贖刑是指允許犯罪者以金錢或財物來折抵原定刑罰的法律制度。中國古代的贖刑制度，歷史悠久，始于西周，至唐代成熟定型，為后世各朝所沿用。唐律中的贖刑，內(nèi)容規(guī)范，條目具體，體例完整，可操作性強，是一項系統(tǒng)化、完備化的法律制度。唐代贖刑在形式上可分為特權(quán)贖、老幼廢疾贖、疑罪贖、過失贖四種，每種類型下都有相應(yīng)的規(guī)定和限制，以防止被濫用。為保證贖刑的實施，唐代還制定了眾多的司法保障措施。盡管贖刑有其本身所不可避免的弊端，，但也有不少的積極意義，對我國現(xiàn)在處置過失犯罪及輕微犯罪方面有著一定的借鑒意義。
[Abstract]:Foreclosure is a legal system in which the offender is allowed to commute the original penalty with money or property. The system of redeeming punishment in ancient China has a long history, from the Western Zhou Dynasty to the Tang Dynasty. The redeeming punishment, the content standard, the item concrete, the style is complete, the maneuverability is strong in Tang Law, is a systematization, the complete legal system. In the Tang Dynasty, the punishment of foreclosure can be divided into four types: privilege redemption, old and young foreclosure, criminal foreclosure and negligent foreclosure. There are corresponding regulations and restrictions under each type in order to prevent abuse. In order to ensure the implementation of foreclosure, Tang Dynasty also formulated a number of judicial safeguards. Although the punishment of foreclosure has its own inevitable drawbacks, but also has a lot of positive significance, for our country now deal with negligent crime and minor crime has certain reference significance.
