【摘要】：景德鎮(zhèn)是著名的瓷業(yè)移民城鎮(zhèn),明清時期,由于瓷業(yè)生產(chǎn)和貿(mào)易繁盛,來自全國各地移民以血緣和地緣為紐帶在景德鎮(zhèn)創(chuàng)辦了以會館和書院為主要承載的公產(chǎn)。這些公產(chǎn)擔(dān)負著救濟同鄉(xiāng)、聯(lián)絡(luò)鄉(xiāng)誼的意義,也詮釋了中國傳統(tǒng)社會慈善理念。但近代以來,由于制瓷業(yè)衰退和社會轉(zhuǎn)型,同鄉(xiāng)公產(chǎn)救濟功能大為削減。民國后期,同鄉(xiāng)公產(chǎn)在失去傳統(tǒng)救濟功能后,僅通過租賃來維系。隨著局勢穩(wěn)定和生產(chǎn)恢復(fù),原有的租賃問題由于同鄉(xiāng)關(guān)系和個人私利產(chǎn)生糾紛,進而引起相關(guān)方矛盾。在財產(chǎn)糾紛中,以公共利益為借口既能實現(xiàn)個人利益最大化,又能取得道德認同的優(yōu)勢,且在法律訴訟中處于有利的地位。公產(chǎn)糾紛中的復(fù)雜關(guān)系讓案件本身變得無足輕重,更多凸顯出訴訟各方利用私人情誼、同鄉(xiāng)關(guān)系所展開的復(fù)雜利益博弈。
[Abstract]:Jingdezhen is a famous porcelain immigrant town. During the Ming and Qing dynasties, due to the prosperity of porcelain production and trade, immigrants from all over the country established the public property mainly carried by guilds and academies in Jingdezhen with blood and geographical ties. These public properties are responsible for the relief of the villagers, the significance of contact with the township, but also annotated the traditional Chinese social concept of charity. But in modern times, due to the decline of porcelain industry and social transformation, the function of public property relief was greatly reduced. In the late period of the Republic of China, after losing the traditional relief function, the public property of fellow townships was maintained only by lease. With the stabilization of the situation and the restoration of production, the original lease problems have caused disputes due to the relationship between the two countries and personal interests, which will lead to contradictions between the related parties. In property disputes, the public interest can not only maximize personal interests, but also gain the advantage of moral identity, and be in a favorable position in legal proceedings. The complex relationship in the public property dispute makes the case itself insignificant, more highlights the parties to the lawsuit to use private friendship, the complex interests of the relationship launched by the game.
