基層普法存在的問題及對策研究

【摘要】:中國共產(chǎn)黨第十八屆中央委員會第四次全體會議通過了《中共中央關(guān)于全面推進依法治國若干重大問題的決定》,在全會公報中,使用頻率最高的“法”字,出現(xiàn)了103次,可見法制工作已經(jīng)成為我國當(dāng)前最大的政治。從1986年“一五”普法到即將在2015年結(jié)束的“六五普法”,中國的普法教育經(jīng)歷了近三十年的發(fā)展歷程。普法宣傳取得了眾所矚目的成績,從法律意識培養(yǎng)、知法水平掌握程度和用法能力提升這些方面,都取得了不錯的效果。法治政府和法制社會建設(shè)都取得了顯著進展,為保障和促進經(jīng)濟社會快速發(fā)展,推進依法治國方略的實施起到了巨大作用。 根據(jù)多年的基層工作和切身感受,筆者認(rèn)為,以政府為主體推進的普法教育在組織和實施的過程中,在法制教育實效方面還存在很多不容忽視的問題,面對社會發(fā)展和當(dāng)前的政治經(jīng)濟生活情勢,,需要重新審視和改進的地方還有很多,因此萌生了結(jié)合實際分析基層普法問題的想法。 本文共分三個部分論述,第一部分“基層普法教育現(xiàn)狀”運用調(diào)查分析法,從歷史層面和現(xiàn)實層面,描述分析基層普法教育中,主體、內(nèi)容、形式、課題等各個方面的總體情況,力求詳實、嚴(yán)謹(jǐn),符合當(dāng)前的社會特征。第二部分主要分析基層普法當(dāng)中存在的問題。在基層普法的現(xiàn)實情境當(dāng)中,普法主體形態(tài)比較單一,多為黨政事業(yè)單位和機關(guān)團體,各個部門職責(zé)交叉界限不清晰,各部門主體對普法教育的重視程度不一,基層普法人員自身的法律素養(yǎng)和業(yè)務(wù)水平也參差不齊。在普法內(nèi)容上,法律體系本身就比較龐雜,所以普法教育本身也容易流于程式化、運動化、來去一陣風(fēng)。這就容易造成普法教育形式主義問題很突出。基層普法缺少新穎的形式,也缺少固定的模式。此外,對普法效果的考核評估,也存在著走過場,重規(guī)模輕實效的問題。而普法對象則處于被動的地位,因為以上因素的綜合制約,造成其本身對普法教育缺少熱情或心態(tài)抵觸。加上社會形勢的復(fù)雜,往往還會有一些普法對象“信訪不信法”。第三部分重點論述重新審視基層普法工作的價值和意義,提出在提高全民的法律素質(zhì)和加快全社會的法制化進程的這個目標(biāo)前提下,如何針對查找出的問題,提出切實可行,符合新媒體時代發(fā)展規(guī)律和普法對象認(rèn)知心理的意見、建議和方法。這些方法主要是,在新的歷史形勢下將普法工作進行新的定位,變政治任務(wù)為素質(zhì)教育和專項服務(wù),動員全社會的力量,根據(jù)各自的資源和特點投入到普法工作中去,普法形式要與時俱進。為增強普法工作實效,要把法律服務(wù)、文化活動和社會管理,都融合進普法工作之中。
[Abstract]:At the fourth plenary session of the 18th Central Committee of the Communist Party of China, the CPC Central Committee adopted the "decision of the CPC Central Committee on promoting the Rule of Law in an All-round way." in the communique of the plenary session, the word "law", which is the most frequently used, appeared 103 times. Visible legal system work already became our country current biggest politics. From "the first five year plan" in 1986 to the "sixth five year law popularization" in 2015, the popularization of law education in China has gone through nearly 30 years of development. The popularization of law has made great achievements, and good results have been obtained from the cultivation of legal consciousness, the improvement of the level of knowledge and the improvement of the ability to use the law. The government ruled by law and the construction of legal society have made remarkable progress, which has played a great role in ensuring and promoting the rapid development of economy and society and promoting the implementation of the strategy of governing the country according to law. Based on years of grass-roots work and personal feelings, the author believes that there are still many problems that can not be ignored in the practical effect of legal education in the process of organizing and implementing the popularizing legal education, which is promoted by the government as the main body. In the face of social development and the current situation of political and economic life, there are still many areas that need to be re-examined and improved. This paper is divided into three parts. The first part, "the present situation of popularizing law education at the grass-roots level", uses the investigation and analysis method to describe and analyze the main body, content and form of the basic level law popularization education from the historical level and the realistic level. Subject and other aspects of the overall situation, strive to be detailed, rigorous, in line with the current social characteristics. The second part mainly analyzes the existing problems in basic law popularization. In the realistic situation of popularizing the law at the grass-roots level, the subject form of the law popularization is relatively single, most of them are party and government institutions and organizations, the cross boundary of the responsibilities of each department is not clear, and the main body of each department pays different attention to the education of popularizing law. The legal literacy and professional level of the legal personnel at the grassroots level are also uneven. In the content of popularizing law, the legal system itself is rather complicated, so the education of popularizing law itself is easy to flow in stylization, movement, and a gust of wind. This is easy to cause the legal education formalism problem is very prominent. The basic level popularizes the law lacks the novel form, also lacks the fixed pattern. In addition, the evaluation of the effectiveness of law popularization, there is also a problem of formality, emphasis on scale and effectiveness. The object of popularizing law is in a passive position, because of the comprehensive restriction of the above factors, it lacks enthusiasm or resistance to the education of popularizing law. In addition to the complexity of the social situation, there will often be some legal objects, "letter to visit or not to believe the law." The third part focuses on the value and significance of re-examining the grass-roots legal popularization work, and puts forward how to put forward practical and feasible solutions to the problems found under the premise of improving the legal quality of the whole people and speeding up the legalization process of the whole society. In line with the new media era development law and the cognitive psychology of the legal object opinions, suggestions and methods. These methods mainly include: under the new historical situation, the work of popularizing the law should be reoriented, political tasks should be changed into quality-oriented education and special services, the forces of the whole society should be mobilized, and their respective resources and characteristics should be put into the work of popularizing the law. The form of law popularization should keep pace with the times. In order to enhance the effectiveness of legal popularization, we should integrate legal services, cultural activities and social management into legal popularization.
