【摘要】：公告類離婚糾紛案件是一類較為特殊的案件,其不僅對于涉及身份關(guān)系的案件采用了公告送達(dá)方式,而且該類案件較其他公告類案件而言除公告送達(dá)風(fēng)險外,還有一層裁判風(fēng)險——裁判離婚的不可逆性,因此對于該類案件的裁判應(yīng)持謹(jǐn)慎的態(tài)度。對于不符合離婚條件的,可以直接判決駁回離婚訴訟請求;對于符合離婚條件的,雖可以裁判離婚,但需法官本著對案件負(fù)責(zé)的精神慎重處理,對于證據(jù)嚴(yán)格審查、主動調(diào)查,對于離婚涉及的子女撫養(yǎng)、財產(chǎn)分割等問題予以謹(jǐn)慎對待。
[Abstract]:Public notice divorce dispute cases are a kind of special cases, which not only adopt notice service mode for cases involving identity relations, but also have more risks than other public announcement cases, in addition to the risk of notice service. There is also a layer of referee risk-the irreversibility of judicial divorce, so the adjudication of such cases should be cautious. For those who do not meet the conditions for divorce, they may directly adjudicate and reject the request for divorce; for those that meet the conditions of divorce, they may adjudicate and divorce, but need the judge to handle the case with caution in the spirit of being responsible for the case, and to examine the evidence strictly and investigate the case on its own initiative. The divorce involves the maintenance of children, property division and other issues to be treated with caution.
