【摘要】：面對(duì)日趨嚴(yán)峻的恐怖主義威脅,馬來(lái)西亞根據(jù)本國(guó)國(guó)情逐步構(gòu)建反恐法律體系,采取以專門(mén)反恐法律為主、其他法律為輔的立法模式。馬來(lái)西亞反恐法律具有嚴(yán)懲恐怖主義犯罪、強(qiáng)化防范性執(zhí)法權(quán)力、弱化人權(quán)保障和重視反恐怖主義融資的特點(diǎn)。借鑒馬來(lái)西亞反恐法律,中國(guó)可從健全反恐刑事特別程序和制定反恐怖主義融資法律等方面完善反恐法律制度。
[Abstract]:Facing the increasingly serious threat of terrorism, Malaysia has gradually constructed a counter-terrorism legal system according to its own national conditions, adopting a legislative model which is mainly based on specialized anti-terrorism laws and supplemented by other laws. The anti-terrorist law of Malaysia has the characteristics of severely punishing terrorist crimes, strengthening preventive law enforcement power, weakening human rights protection and attaching importance to anti-terrorist financing. Using Malaysia's anti-terrorism laws for reference, China can perfect the anti-terrorism legal system from the aspects of perfecting the anti-terrorism criminal special procedures and formulating anti-terrorism financing laws.
