【摘要】：權(quán)利傾斜性配置立法是指國(guó)家立法機(jī)關(guān)通過(guò)立法的方式對(duì)同一法律關(guān)系中的不同主體按照其法律地位的相對(duì)性傾斜性地配置額外的權(quán)利或義務(wù),用以彌補(bǔ)由于社會(huì)分層所產(chǎn)生的強(qiáng)弱兩種群體之間的不平等,實(shí)現(xiàn)社會(huì)實(shí)質(zhì)正義。在表現(xiàn)形式上,權(quán)利傾斜性配置立法散見于我國(guó)憲法、法律及其他規(guī)范性法律文件中;而在內(nèi)容上,權(quán)利傾斜性配置立法則包括了對(duì)弱勢(shì)方權(quán)利的傾斜保護(hù)以及對(duì)其相對(duì)方權(quán)利的限制兩個(gè)方面。對(duì)現(xiàn)有的相關(guān)法律規(guī)范進(jìn)行分析則會(huì)發(fā)現(xiàn),權(quán)利傾斜性配置立法在立法內(nèi)容和法律的實(shí)施過(guò)程中都存在著不同程度的問(wèn)題。其立法內(nèi)容中存在著使“身份歧視”合法化和誘發(fā)道德風(fēng)險(xiǎn)兩大缺陷;而在法律運(yùn)行的過(guò)程中又出現(xiàn)“權(quán)利空置化”和容易激化社會(huì)矛盾兩大問(wèn)題。究其根源,在于其對(duì)主體的簡(jiǎn)單化處理、權(quán)利傾斜性配置立法的限度不明確以及家長(zhǎng)式立法下責(zé)任的不當(dāng)轉(zhuǎn)嫁三個(gè)方面。鑒于此,立法者在進(jìn)行權(quán)利傾斜性配置立法的時(shí)候應(yīng)該注意以下幾個(gè)問(wèn)題:主體的多層次設(shè)計(jì)、權(quán)利傾斜配置立法的“度”的考量以及適當(dāng)限制家長(zhǎng)式立法。
[Abstract]:The legislation on the disposition of rights refers to the allocation of additional rights or obligations to different subjects in the same legal relationship according to the relativity of their legal status by means of legislation by the national legislature. In order to make up for the inequality between the strong and weak groups caused by social stratification, realize the social substantive justice. In the form of expression, the legislation on the disposition of rights is scattered in the constitution, law and other normative legal documents of our country, while in the content, the legislation of disposition of rights is scattered in our constitution, law and other normative legal documents. The legislation on the disposition of rights includes two aspects: the protection of the rights of the vulnerable party and the restriction of the rights of the opposite party. Through the analysis of the existing relevant legal norms, we can find that there are some problems in the legislative content and the implementation of the law. There are two defects in its legislation content: legalization of "identity discrimination" and inducing moral hazard, while "emptiness of rights" and easy to intensify social contradictions occur in the course of legal operation. The reason lies in three aspects: the simplification of the subject, the unclear limitation of the legislation on the disposition of rights and the improper transfer of responsibility under the paternalistic legislation. In view of this, the legislator should pay attention to the following problems when carrying out the legislation of the right tilt allocation: the multi-level design of the subject, the consideration of the "degree" of the legislation of the right tilt allocation, and the appropriate restriction of the paternalistic legislation.
