【摘要】：德國建設(shè)規(guī)劃理念經(jīng)歷了警察專制與建設(shè)自由、規(guī)劃理念的誕生、現(xiàn)代規(guī)劃理念的形成三個(gè)發(fā)展階段。在現(xiàn)代規(guī)劃理念的指導(dǎo)下,德國建設(shè)規(guī)劃已形成"三規(guī)一體"的有序格局,并且具有科學(xué)的編制模式�，F(xiàn)有建設(shè)規(guī)劃體系由空間總體規(guī)劃、建設(shè)指導(dǎo)規(guī)劃與專項(xiàng)規(guī)劃三者組成,互相協(xié)調(diào),層次分明。建設(shè)規(guī)劃的編制則擁有獨(dú)特的規(guī)范構(gòu)造、自由的衡量空間與廣泛的參與程序。以德國經(jīng)驗(yàn)為借鑒,我國應(yīng)在探求規(guī)劃管理的憲法正當(dāng)性基礎(chǔ)、促進(jìn)統(tǒng)一建設(shè)規(guī)劃體系的形成與加強(qiáng)規(guī)劃編制的科學(xué)性方面繼續(xù)努力,將建設(shè)規(guī)劃的發(fā)展真正納入法治化軌道,為新型城鎮(zhèn)化戰(zhàn)略實(shí)施提供助力。
[Abstract]:German construction planning concept has experienced three stages of development: police autocracy and freedom of construction, the birth of planning idea and the formation of modern planning idea. Under the guidance of modern planning concept, German construction planning has formed an orderly pattern of "three rules" and has a scientific formulation model. The existing construction planning system is composed of spatial master planning, construction guidance planning and special planning. Construction planning has a unique normative structure, a free measurement space and a wide range of participatory procedures. Taking the experience of Germany as a reference, our country should continue its efforts in seeking the constitutional legitimacy of planning management, promoting the formation of a unified construction planning system and strengthening the scientific nature of planning, so as to truly bring the development of construction planning into the track of rule of law. To provide assistance for the implementation of new urbanization strategy.
