【摘要】：新疆是我國許多少數(shù)民族的聚居地。這里的一些少數(shù)民族自古以來深受伊斯蘭教影響,形成了自己的習(xí)慣法。新疆穆斯林習(xí)慣法不等同于伊斯蘭教法,它是在教法的影響下,結(jié)合民族習(xí)慣和時代因素而逐漸形成的。這也必然使新疆穆斯林習(xí)慣法與國家法表現(xiàn)出各種不同的關(guān)系,探討這些關(guān)系對于了解新疆穆斯林的法律意識、民族心理,完善國家法律體系,維護國家法律權(quán)威,加強民族團結(jié),維護地區(qū)穩(wěn)定都具有重要意義。 本文首先界定新疆穆斯林習(xí)慣法的概念,比較其與伊斯蘭教法的異同,然后分析國家法在新疆地區(qū)現(xiàn)狀。在此基礎(chǔ)上,給出新疆穆斯林習(xí)慣法與國家法的各種關(guān)系,并用空間幾何學(xué)理論進行驗證,進而舉出習(xí)慣法和國家法各自有代表性的規(guī)定進行說明。在舉例說明習(xí)慣法和國家法的關(guān)系時,我們也發(fā)現(xiàn)它們之間存在的問題。這些問題既有具體的法律規(guī)定的問題,也有抽象的制度問題。在文章的最后部分,我們一并給出這些問題的解決辦法。
[Abstract]:Xinjiang is home to many ethnic minorities in China.Some of the minorities here have been deeply influenced by Islam since ancient times, forming their own customary law.Muslim customary law in Xinjiang is not equal to sharia law, it is formed gradually under the influence of Shariah and national custom and times factor.This will inevitably make the Muslim customary law and the state law in Xinjiang show various kinds of different relations. Discussing these relations will help to understand the legal consciousness, national psychology, perfect the legal system of the state and safeguard the legal authority of the state.Strengthening national unity and maintaining regional stability are of great significance.This paper first defines the concept of Muslim customary law in Xinjiang, compares its similarities and differences with Islamic law, and then analyzes the current situation of national law in Xinjiang.On this basis, various relations between Muslim customary law and national law in Xinjiang are given, verified by spatial geometry theory, and the representative provisions of customary law and national law are given.In illustrating the relationship between customary law and national law, we also find the problems between them.These problems not only have specific legal provisions, but also abstract system problems.In the final part of the article, we also give the solutions to these problems.
