【摘要】：本文從法哲學(xué)的角度,以人格、權(quán)利為核心,通過對西方近代以來法律思想知識譜系的考察,探討法的精神的現(xiàn)代內(nèi)容及其演進(jìn)過程,揭示法權(quán)人格理念的豐富內(nèi)涵,并為我國法治建設(shè)提供理論支持。在研究方法上,以“法權(quán)人格”為視角,通過對英、法、德、美四國近代以來的主要經(jīng)典法權(quán)思想進(jìn)行分別探究,揭示西方近代以來法權(quán)人格思想的具體內(nèi)容。 本文通過深入西方經(jīng)典文本仔細(xì)梳理,揭示了西方近代以來法權(quán)人格思想理論演進(jìn)的邏輯過程,這個過程是,從西方近代資產(chǎn)階級爭取自由平等權(quán)利的思想,限制權(quán)力理路下的法權(quán)人格至上與保障理念；反專制、求平等的法權(quán)人格理論；法哲學(xué)上的自由人格共存與承認(rèn)理論；到當(dāng)代的制度正義下的自由和平等的法權(quán)人格理念。貫穿這個過程的基本思想精髓是：法權(quán)人格是所有人具有平等自由權(quán)利的普遍平等人格,且這些平等人格的平等自由權(quán)利得以法的方式表達(dá),并受到法的平等有效保護(hù)。人人在法的意義上都被看作享有平等的自由權(quán)利的人,任何人的法權(quán)都得到法的平等保護(hù),這種法權(quán)人格理念應(yīng)當(dāng)被視為現(xiàn)代法治的根本精神和最高原則�！胺�(quán)人格”的要義是,要用法來對個人任性和權(quán)力的任意加以限制,使每個人的人格尊嚴(yán)和權(quán)利得到法的有效保護(hù)。法權(quán)人格正是現(xiàn)代法治之本,現(xiàn)代法治是法權(quán)人格理念的“體”與“用”。
[Abstract]:From the point of view of legal philosophy, taking personality and right as the core, this paper probes into the modern content and evolution process of the spirit of law and reveals the rich connotation of the concept of personality of right of law through the investigation of the knowledge genealogy of legal thought since modern times in the West.And provides the theory support for our country rule of law construction.From the perspective of "juristic personality", this paper probes into the main classical juristic thoughts of Britain, France, Germany and the United States from the perspective of "juristic personality", and reveals the concrete contents of the thought of juristic personality since modern times in the West.Through a thorough analysis of the classical texts of the West, this paper reveals the logical process of the evolution of the theory of juristic personality since the modern times of the West, which is the idea of striving for freedom and equal rights from the modern bourgeoisie in the West.The doctrine of the supremacy and guarantee of legal personality under the road of restricting power; the theory of anti-autocracy and seeking equality of juristic personality; the theory of coexistence and recognition of free personality in legal philosophy; and the concept of freedom and equal juristic personality under contemporary institutional justice.The essence of the basic thought that runs through this process is that legal personality is the universal and equal personality of all people with equal and free rights, and the equal and free rights of these equal personalities can be expressed in the way of law and protected by law equally and effectively.In the sense of law, everyone is regarded as the person with equal rights of freedom, and everyone's right of law is protected equally by law. This concept of legal personality should be regarded as the fundamental spirit and supreme principle of modern rule of law.The essence of "juristic personality" is to use it to restrict the arbitrariness and power of individuals, so that the human dignity and rights of each person can be effectively protected by law.The personality of legal right is the root of modern rule of law, and modern rule of law is the body and use of the concept of legal personality.
