【摘要】：隨著新《刑事訴訟法》及相關(guān)司法解釋的正式實(shí)行,我國(guó)對(duì)偵查活動(dòng)的規(guī)范更為嚴(yán)格,偵查訊問(wèn)模式也逐步從身體強(qiáng)制過(guò)渡為心理強(qiáng)制。心理強(qiáng)制時(shí)代的發(fā)展帶來(lái)了豐富多樣的訊問(wèn)策略,但卻加大了識(shí)別和預(yù)防虛假供述的難度。為了保障有罪供述的真實(shí)性和偵查工作的效率,通過(guò)對(duì)比研究美國(guó)心理強(qiáng)制時(shí)代訊問(wèn)的發(fā)展經(jīng)驗(yàn),認(rèn)為應(yīng)在監(jiān)禁期間全程錄音錄像;建立訊問(wèn)策略評(píng)估機(jī)制;規(guī)定具體的訊問(wèn)時(shí)間長(zhǎng)度;保障特殊群體的律師在場(chǎng)權(quán)等方面尋求我國(guó)訊問(wèn)模式的發(fā)展之路。
[Abstract]:With the formal implementation of the new Criminal procedure Law and related judicial interpretations, the norms of investigation activities in our country are more strict, and the mode of investigation and interrogation has gradually changed from physical compulsion to psychological compulsion.The development of the era of psychological compulsion has brought a variety of interrogation strategies, but it has increased the difficulty of identifying and preventing false confessions.In order to guarantee the truthfulness of confession and the efficiency of investigation, through the comparative study of the development experience of interrogation in the era of psychological compulsion in the United States, the author holds that the whole process of interrogation should be recorded and videotaped during the period of imprisonment, and the evaluation mechanism of interrogation strategy should be established.The specific length of interrogation time and the protection of the right of lawyers of special groups to be present to seek the way of the development of interrogation mode in China.
