【摘要】：源遠(yuǎn)流長(zhǎng)的中華文化以其獨(dú)特的面貌綿延不絕地流淌在人類文明的長(zhǎng)河之中,這也為不同學(xué)科的研究者提出了一個(gè)共同的問(wèn)題:中華文明為何得以經(jīng)歷一次次浩劫而不滅,并以綿延五千年的面貌屹立在世界的東方?立足于法律史的學(xué)科背景,我們不禁要思考,是否是因?yàn)橹腥A法系的精妙高超所勾勒出的社會(huì)框架和行為規(guī)范,為中華文明的發(fā)展起到了保駕護(hù)航之功。當(dāng)然,這一點(diǎn)無(wú)可厚非,作為世界五大法系之一的中華法系,其立法技藝的精湛早已為世人所肯定。受到長(zhǎng)期以來(lái)學(xué)術(shù)傳統(tǒng)的影響,作為立法技藝集中體現(xiàn)的國(guó)家成文法典,吸引了絕大多數(shù)法史學(xué)研究者的目光,而以家族法為代表的民間法一直以來(lái)卻未能得到學(xué)術(shù)界的應(yīng)有重視。基于中國(guó)傳統(tǒng)社會(huì)的獨(dú)特結(jié)構(gòu)與文化背景,除了官方所制定的成文法典外,家族法實(shí)際上在民間社會(huì)所起的作用是非常重要的。甚至從某種意義上說(shuō),正是因?yàn)檫@些以家族為社會(huì)基本單位而發(fā)揮作用的家族法,使得即使王朝更迭政權(quán)輪替,中國(guó)傳統(tǒng)的民間社會(huì)卻一直保持著相對(duì)穩(wěn)定性,從而為中華文化的傳承提供了一個(gè)非常寶貴的空間。那么,家族法究竟在中國(guó)傳統(tǒng)社會(huì)中發(fā)揮了一種怎樣的作用,又是如何發(fā)揮作用,其與國(guó)家法是如何進(jìn)行互動(dòng)而共同作用于中國(guó)傳統(tǒng)社會(huì)的?這些都是考察中國(guó)傳統(tǒng)家族法所需要解決的問(wèn)題。因此,本文立足于此,以中國(guó)傳統(tǒng)家族法為考察對(duì)象,以社會(huì)控制為核心的理論加以分析,從而深入闡述中國(guó)傳統(tǒng)家族法的一些基本問(wèn)題,主要包括內(nèi)部結(jié)構(gòu)與外部互動(dòng)兩個(gè)方面,并在此基礎(chǔ)上最終回到現(xiàn)實(shí),將中國(guó)傳統(tǒng)家族法的歷史價(jià)值賦予現(xiàn)實(shí)的意義。
[Abstract]:The long history of Chinese culture with its unique features which the Jedi flowing in the long process of human civilization, it also puts forward a common problem for researchers in different disciplines: why Chinese civilization experienced a catastrophe and death, and in the face of 5000 years standing in the east of the world based on the history of law? The subject background, we have to wonder whether it is because of the Chinese legal system, the outline of the superb subtle social framework and behavior, to escort the power for the development of Chinese civilization. Of course, this point can thick, as one of the five main legal systems in the world of Chinese law system, the legislation has been superb skills have been acknowledged by the world. Influenced by the academic tradition for a long time, as the art of legislation embodies the state statutes, the vast majority of historical research method to attract the eyes, and to family law As a representative of the folk law has failed to receive due attention in academic circles. The unique structure and cultural background China based on traditional society, in addition to the formulation of the official written law, family law actually played in the role of civil society is very important. To some extent, it is because of the family as the basic unit of society and play the role of the family, so that even the change of dynasty political power, Chinese traditional civil society remained relatively stable, and thus provides a very valuable space for the inheritance of Chinese culture. So, the family law has actually played a role in how China in traditional society, and how to play the role, which is how to interact and work together to China traditional society and the state law? These are investigated Chinese traditional family law to solve the problem. This paper, based on this, Chinese to the traditional family law as the object of study, analyzes on the social control as the core theory, and elaborates some basic problems of the traditional family China method, including the internal structure and external interaction in two aspects, and on the basis of the final return to reality, will give the practical significance China the traditional family law historical value.
