【摘要】：建國初期的法制變革,在制度和觀念兩個層面展開。相較于法律制度的廢立,法律觀念尤其是鄉(xiāng)村法律觀念的轉(zhuǎn)型,更為復雜和艱難,更加具有中國特色。在1952年的司法改革運動中,中共借鑒群眾運動的經(jīng)驗,通過話語轉(zhuǎn)化、組織控制和圖景展示三種手段,成功地在鄉(xiāng)村塑造了新法律觀念。這一偉大歷史過程,反映了建國初期中共對法制建設的探索,體現(xiàn)了中共靈活的政治運作、求是的群眾作風和強大的組織動員。
[Abstract]:The legal system reform in the early days of the founding of the people's Republic of China was carried out at the two levels of system and concept. Compared with the abolition of the legal system, the transformation of the concept of law, especially in the countryside, is more complicated and difficult. More with Chinese characteristics. In the 1952 judicial reform movement, the CPC used the experience of the mass movement as a reference, through three means: discourse transformation, organizational control and picture display. This great historical process reflects the exploration of the construction of the legal system in the early days of the founding of the people's Republic of China, the flexible political operation of the Communist Party of China, the mass style of seeking truth and the strong organizational mobilization.
