得房率縮水糾紛中的司法衡平

【摘要】:正【裁判要旨】得房率縮水是否構成違約,法律沒有明確的規(guī)則可資援引,應進行司法衡平。通過對外部因素和內(nèi)部因素的考察,可得出的結(jié)論是:買受人的利益應獲得保護,對其保護范圍為得房率縮水超過合理誤差給買受人造成的損失;買受人損失的確定以得房率縮水造成套內(nèi)建筑面積減少的價值為基數(shù),結(jié)合買受人因此所受利益損益相抵,酌情確定。
[Abstract]:Whether or not the shrinking rate of home ownership constitutes a breach of contract, the law has no clear rules to invoke, and there should be a judicial balance. Through an examination of external and internal factors, it can be concluded that the interests of the buyer should be protected. The scope of protection is the loss caused to the buyer by the shrinkage of the rate of the acquired house more than the reasonable error; the determination of the loss of the buyer is based on the value of the reduction of the building area in the suite caused by the shrinkage of the rate of the acquired house, and is offset by the benefits and losses of the buyer as a result, As appropriate.
