【摘要】：董仲舒秉承孔孟、黃老學(xué)說思想,融合法、墨、陰陽眾家觀點形成了自成一體的法律思想體系,提出"大一統(tǒng)"的政治主張,在法律思想上提出德主刑輔、《春秋》決獄、三綱五常的法治理念和制度,其法律思想在古代皇權(quán)社會法律系統(tǒng)中發(fā)展中占據(jù)重要地位,對當(dāng)前我國生態(tài)法制建設(shè)和現(xiàn)代公民思想素質(zhì)的提高具有重要現(xiàn)實意義。
[Abstract]:Following the ideas of Confucius and Mencius and Huang Lao, integrating law, Mo, Yin and Yang, Dong Zhongshu formed his own legal thought system, put forward the political idea of "unification of great powers", and put forward the idea of "virtue dominating punishment and auxiliary punishment" in his legal thought, and the "Spring and Autumn period" decided on the prison. The concept and system of the rule of law of Sangang and Wuchang occupies an important position in the development of the legal system of ancient imperial power society, which is of great practical significance to the construction of ecological legal system and the improvement of the ideological quality of modern citizens in our country.
