先行法治化理論初探

【摘要】:法治是一個(gè)漸進(jìn)化的過(guò)程,法治國(guó)家的實(shí)現(xiàn)不可能一蹴而就。由于我國(guó)幅員遼闊,東西部條件的差異巨大,地區(qū)發(fā)展不平衡現(xiàn)象嚴(yán)重,在全國(guó)范圍內(nèi)統(tǒng)一實(shí)行一種法治發(fā)展標(biāo)準(zhǔn)具有很大難度。一些經(jīng)濟(jì)發(fā)達(dá)地區(qū)的法治建設(shè)已經(jīng)滯后于經(jīng)濟(jì)發(fā)展,當(dāng)?shù)孛癖姼侨狈Α鞍踩小。?jīng)濟(jì)基礎(chǔ)決定上層建筑,生產(chǎn)的發(fā)展總是要求上層建筑為其發(fā)展掃除障礙、拓寬道路并提供制度保障。因此,我們應(yīng)當(dāng)而且必須探索新型的法治發(fā)展理論及模式。 “先行法治化”是指中國(guó)東部地區(qū)在其經(jīng)濟(jì)與社會(huì)“先發(fā)”的基礎(chǔ)上,在國(guó)家法制統(tǒng)一原則下,率先推進(jìn)區(qū)域法治化。法治國(guó)家的實(shí)現(xiàn)有時(shí)間上的階段性和區(qū)域上的不平衡性,在社會(huì)經(jīng)濟(jì)相對(duì)發(fā)達(dá)的地區(qū)率先實(shí)現(xiàn)法治國(guó)家目標(biāo)完全是可能的,也是必要的!伴L(zhǎng)三角”地區(qū)的法治先發(fā)跡象告訴我們,先行法治化是實(shí)現(xiàn)法治國(guó)家的有效途徑,在我國(guó)現(xiàn)實(shí)國(guó)情的土壤下具有很大的生長(zhǎng)空間。但是,由于先行法治化理論方面的相對(duì)欠缺,法治建設(shè)經(jīng)驗(yàn)的相對(duì)不足,在一些地方先行法治化的過(guò)程中難免出現(xiàn)一些始料不及的問(wèn)題。比如,地方立法結(jié)構(gòu)不平衡、政治體制改革相對(duì)落后、政府職能轉(zhuǎn)變不到位、司法體制不健全、公眾參與的平等性不強(qiáng)等等。因此,我們必須面對(duì)和解決好這些問(wèn)題,探索出一條適合中國(guó)國(guó)情的先行法治化道路。 在法律發(fā)展和法治建設(shè)中,存在兩條比較基本、又相互區(qū)別的模式,即政府推進(jìn)型與社會(huì)演進(jìn)型。在二者的博弈和選擇下,并緊密聯(lián)系我國(guó)的現(xiàn)實(shí),我們選擇了一條政府推動(dòng)與社會(huì)演進(jìn)相結(jié)合并互動(dòng)的路徑。在這條道路上,沒(méi)有相關(guān)法律依據(jù)和制度建設(shè),先行法治化將步履維艱。事實(shí)也證明,長(zhǎng)三角區(qū)域先行法治化的進(jìn)程中,首先解決的也是立法的問(wèn)題。法治先行必須首先要解決的是有法可依的問(wèn)題。因此,先行法治化應(yīng)立法先行。
[Abstract]:The rule of law is a gradual process, and the realization of a country ruled by law cannot be achieved overnight. Due to the vast territory of our country, the huge differences in conditions between the east and the west, and the serious imbalance in regional development, It is very difficult to implement a unified development standard of rule of law throughout the country. The construction of the rule of law in some economically developed areas has lagged behind economic development, and the local people are even less secure. The economic base determines the superstructure. The development of production always requires superstructure to remove obstacles, widen roads and provide system guarantee for its development. Therefore, we should and must explore new development theories and models of rule of law. "first ruling by law" means that the eastern region of China, on the basis of its economic and social "first development" and under the principle of the unification of national legal system, takes the lead in promoting the rule of law in the region. The realization of a country ruled by law has a period of time and a regional imbalance. It is entirely possible and necessary to take the lead in realizing the goal of a country governed by law in areas with relatively developed social and economic conditions. The first signs of the rule of law in the "Yangtze River Delta" region tell us that the rule of law in advance is an effective way to achieve the rule of law in a country ruled by law. There is a lot of room for growth in the soil of our country's actual national conditions. However, due to the relative lack of the theory of rule of law in advance, the experience in the construction of the rule of law is relatively insufficient. Some unexpected problems inevitably arise in the process of leading the rule of law in some places. For example, the local legislative structure is unbalanced, the political system reform is relatively backward, the government functions are not in place, and the judicial system is not perfect. Therefore, we must face and solve these problems well, and explore a way to rule by law that is suitable for China's national conditions. In the development of law and the construction of the rule of law, there are two relatively basic and different models, that is, the type of government advancing and the type of social evolution, under the game and choice of the two, and in close connection with the reality of our country, We have chosen a path in which the government promotes and interacts with the evolution of society. On this road, there is no relevant legal basis and institutional construction, and the rule of law in advance will be difficult. Facts have also proved that, In the process of the rule of law in the Yangtze River Delta region, the first problem to be solved is the legislation. The first thing that the rule of law must solve is that there are laws to be followed. Therefore, the leading rule of law should be legislated first.
