【摘要】：借鑒和研究各時期各國別的司法人道主義思想,對當今中國的司法體制改革具有現(xiàn)實裨益。沈家本將人道主義的司法思想運用作為其整體司法思想之中的一部份。司法慎刑、司法寬和與司法教化思想,共同構成了一個整體意義上的沈家本司法人道主義思想。司法慎刑是司法人道主義的實踐觀,司法寬和是司法人道主義的價值觀,司法教化是司法人道主義的目的觀。沈家本的司法人道主義思想圍繞著司法理念自成一體,散發(fā)著獨特的人文魅力與人道精神。雖然其司法人道主義思想帶有一定程度的歷史局限性,但是歷史地看,其司法人道主義理念和思想的闡發(fā),成為了近代中國傳統(tǒng)人道主義向現(xiàn)代人道主義過渡的一種助推器。將中國的法制過程,著實地朝著先進的方向推了一把。這卻又是他孜孜以求的歷史貢獻。
[Abstract]:Drawing lessons from and studying other judicial and humanitarian thoughts in various countries in various periods is of practical benefit to the reform of the judicial system in China today. Shen Jiaben took the humanitarian judicial thought as a part of his overall judicial thought. The thoughts of judicial leniency and judicial education constitute Shen Jiaben's thought of judicial humanitarianism in the whole sense. Judicial prudence is the practical view of judicial humanitarianism, and judicial leniency is the value of judicial humanitarianism. Judicial education is the aim of judicial humanitarianism. Shen Jiaben's thought of judicial humanitarianism revolves around the judicial idea. It has a unique humanistic charm and humanitarianism spirit. Although its thought of judicial humanitarianism has some historical limitations, but historically, its judicial humanitarianism idea and thought are elucidated. It has become a booster for the transition from modern Chinese traditional humanitarianism to modern humanitarianism.
