論我國社會轉(zhuǎn)型期法律與道德的沖突及協(xié)調(diào)

【摘要】:在當(dāng)前我國社會的轉(zhuǎn)型時期,市場經(jīng)濟的飛速發(fā)展在帶給人們物質(zhì)生活富裕的同時,也急需一套與市場經(jīng)濟相適應(yīng)的上層建筑的規(guī)范和價值系統(tǒng)。法律與道德作為人類社會規(guī)范的兩個不同維度,是社會控制體系中的兩個子系統(tǒng),對矯正市場經(jīng)濟條件下人們的行為具有重要作用。 社會主義市場經(jīng)濟的發(fā)展所帶來的是人們價值的多元化,這使傳統(tǒng)的法律與道德已經(jīng)無法與社會的發(fā)展同步,,法律與道德的沖突的現(xiàn)象開始屢見不鮮。于是在社會上出現(xiàn)了兩種現(xiàn)象:一是某種行為合乎法律的要求,但其喪失了道德的評判;另外一種是某種行為是高尚道德的,但卻因不合法而受到法律的懲罰。前者如“見死不救”、“挾尸索價”,后者如“大義滅親”、用私刑懲治小偷等。關(guān)于“合法”與“合理”問題的爭論,實際上反映了兩種不同社會規(guī)范的內(nèi)在矛盾和沖突。同時,也是法律與道德價值取向的不同所致。 透過這些紛繁復(fù)雜的法律與道德沖突的現(xiàn)象和行為,從理論上對這些沖突進行各個層面的分析得知,導(dǎo)致二者沖突的原因主要有:道德與法律兩種行為評價標(biāo)準(zhǔn)不一致;道德與法律所追求的價值目標(biāo)存在差異;傳統(tǒng)道德的等級觀念與現(xiàn)代法治要求的平等觀念不同;道德的義務(wù)本位與法律的權(quán)利本位的追求不同;傳統(tǒng)道德演進與現(xiàn)代法律發(fā)展的不同步等等。 既然法律與道德的沖突既有相互強化的的一致性,也存在種種沖突,就必須尋求在社會轉(zhuǎn)型期解決問題的有效辦法,正確處理二者相互關(guān)系。本文認(rèn)為化解法律和道德的沖突,協(xié)調(diào)二者關(guān)系的戰(zhàn)略選擇是:一是堅持法律至上的原則;二是法律及時的吸納社會主流道德,更新自身的道德內(nèi)涵;三是道德對法律進行輔助,肯定道德對法律的補充和強化作用。具體的辦法包括:法律道德化,使某些法律回歸道德,使法律如道德一樣成為一種信仰;道德法律化,從意識層面和制度層面,使道德的精神逐漸滲透和被納入現(xiàn)代法律文化中,體現(xiàn)法律的道德性;整合法律與道德資源,共同促進轉(zhuǎn)型社會的發(fā)展,實現(xiàn)社會效果和司法效果。這樣才能使法律與道德做到相互滲透、相互補充、相互促進、相互配合、相輔相成,共同擔(dān)當(dāng)起維護社會和諧發(fā)展的任務(wù)。
[Abstract]:In the current period of social transformation in China, the rapid development of the market economy has brought people material prosperity at the same time. There is also an urgent need for a set of superstructure norms and value systems adapted to the market economy. As two different dimensions of human social norms, law and morality are two subsystems of the social control system. It plays an important role in correcting people's behavior under the condition of market economy. The development of socialist market economy has brought about the diversification of people's values, which makes the traditional law and morality unable to keep pace with the development of society. The conflict between law and morality began to be common, and two phenomena appeared in society: one was that a certain act met the requirements of the law, but it lost its moral judgment; the other was that a certain act was noble and moral. But they are punished by the law because of their illegality. The former, such as "not saving the dead" and "asking for the price of the body," and the latter, such as "extermination of relatives," using lynchings to punish thieves, and so on, have been punished by the law. The controversy over the issues of "legality" and "reasonableness," In fact, it reflects the internal contradictions and conflicts between the two kinds of social norms, and at the same time, it is also the result of the different orientation of law and moral value. Through these complicated phenomena and behaviors of legal and moral conflicts, it is found from the theoretical analysis of these conflicts that the main causes of the conflicts are: the inconsistency between moral and legal behavior evaluation standards; There are differences in the value goals pursued by morality and law, the difference between the traditional moral hierarchy concept and the equality concept required by the modern rule of law, the difference between the moral obligation standard and the legal right standard, and the difference between the traditional moral hierarchy concept and the modern rule of law. The evolution of traditional morality and the development of modern law are out of step and so on. Since conflicts between law and morality are both mutually reinforcing and conflicting, it is necessary to seek effective solutions to problems in the transition period of society, This paper holds that the strategic choice of resolving the conflict between law and morality and coordinating the relationship between them is: first, to adhere to the principle of law first, second, to absorb the mainstream morality of society in time, and to renew the moral connotation of the law itself; Third, morality complements the law and affirms the complement and reinforcement of morality to the law. The specific methods include: legal moralization, making some laws return to morality, making law become a kind of belief like morality; moral legalization, From the level of consciousness and system, the spirit of morality is gradually infiltrated and brought into the modern legal culture, which embodies the moral character of law, integrates the resources of law and morality, and promotes the development of the transitional society. Only in this way can law and morality permeate, complement, promote and complement each other, complement each other, complement each other, and jointly undertake the task of safeguarding the harmonious development of society.
