【摘要】：德國是發(fā)達國家中第一個對網(wǎng)絡(luò)不良信息進行立法監(jiān)管的國家,并且對有害言論的法律制裁和行政處罰措施非常嚴格。本文通過對德國保護青少年的網(wǎng)絡(luò)媒體法制的立法進程的深層分析,總結(jié)出德國在網(wǎng)絡(luò)信息保護中獨具一格的“受管制之自我管制”制度及“網(wǎng)絡(luò)分級”制度。在該制度下,德國對互聯(lián)網(wǎng)內(nèi)容的監(jiān)管主要是通過兩個層次來實現(xiàn),一是通過立法、不斷完善法律體系來加強監(jiān)管,2003年4月的《青少年保護法》及不斷修訂的《青少年媒體保護州際協(xié)議》這2部法律明確劃分了德國聯(lián)邦及各州的管轄權(quán)限,形成了德國網(wǎng)絡(luò)“防毒”體系的保護傘;二是通過互聯(lián)網(wǎng)行業(yè)自律和技術(shù)手段,加強政府部門與社會各機構(gòu)的分工配合。最后本文通過中德兩國青少年網(wǎng)絡(luò)安全保護的對比,為我國的青少年網(wǎng)絡(luò)信息安全的立法管制指明了改進方向和提出了實際建議。
[Abstract]:Germany is the first regulation of bad information in the network state in the developed countries, and legal sanctions against harmful speech and administrative penalties are very strict. Through the deep analysis of the legislative process of the German youth protection network media legal system, summed up the German unique in the network information protection in "self control" control system and network grading system. Finally, by comparing the network security protection between Chinese and German youth, this paper points out the direction for improvement and the practical suggestions for the legislation regulation of youth internet information security in China.
