【摘要】：對五代刑事法律制度的評價,從宋代開始并一直延續(xù)至今,在不同的時期,人們從不同的立場和角度都進行過評判,所得出的結論也不盡相同。很多學者對五代法制尤其是刑事法律制度的評價,持否定態(tài)度的觀點居多。但筆者認為,五代時期的刑事法律制度與唐代相比,雖然有失嚴酷,但亦有進步之處。五代是一個風云際會的時代,彼時變亂頻仍,局勢動蕩,各種社會問題層出不窮。時勢的變化,導致了五代刑事法律制度也隨之發(fā)生較大的變化并呈現(xiàn)出自己的一些特點。五代繼承了唐代的刑法原則,并使之更為明確和完善,比如在共犯地位的劃分上,采用“同情”及“知情”的區(qū)分,是對唐代處理共犯原則的一重大發(fā)展。而五代在刑罰制度上的殘酷化以及重法懲處盜賊等罪名,加重對某些犯罪的懲處,則要根據五代所處的歷史環(huán)境來分析：一方面我們要認識到五代刑法趨于殘酷的事實,另一方面我們也要看到,五代繼承和沿用了唐代中后期的已經失于寬簡的刑罰制度,又加上五代亂世,按照中國古代“刑罰世輕世重”“刑亂國用重典”的原則,其刑罰制度趨于嚴酷亦在情理之中。同時五代作為承唐啟宋的過渡時期,其刑事法律制度的變化和發(fā)展對宋代及后世也產生了深遠的影響。因此,對五代刑事法律制度的諸種變化予以考究,以探討它對宋代及后世產生怎樣的影響,就顯得很有必要且極具學術價值。 本文首先著重介紹五代刑事法律制度與唐代相比較產生的一些重大變化,繼而從這些變化中總結出五代刑事法律制度自身呈現(xiàn)出的特點,最后在對五代刑事法律制度變化成因分析之后,深入探討了五代刑事法律制度種種變化對宋代及后世造成的深遠影響。全文分為三個部分：引言、正文和結語。 引言部分著重介紹了五代法制史研究的現(xiàn)狀和相關的研究成果。 正文分為三個部分。第一部分著重探討了五代刑事法律制度較唐代產生的變化。五代的刑事法律原則在繼承唐代基礎上又有所變化和發(fā)展,表現(xiàn)在：官當和贖刑制度初期并無定制,后來規(guī)定的官當和贖刑在內容上,對官員的優(yōu)容不如唐代；罪過認定上矯正了唐中后期的一些錯誤做法,恢復和發(fā)展了唐代前期確定的某些進步規(guī)定；共同犯罪的處理上區(qū)分“知情”與“同情”,實為一大創(chuàng)舉,較唐代更為進步。五代刑罰制度較唐代有重大的變化,整體上趨于殘酷,表現(xiàn)在：杖刑適用范圍擴大,廣泛使用配刑和刺配入刑,死刑執(zhí)行方式也發(fā)生很大變化。五代在某些具體罪名的量刑上較唐代也有所不同,很多罪行的處罰在不同程度上有所加重。正文第二部份論述了五代刑事法律自身的特點。五代時期定罪時要依據敕的規(guī)定,敕的地位要高于律和格；五代刑法嚴苛,各代多制定峻法,而且多濫用酷刑和肉刑,刑罰更加殘酷。正文第三部份探討了五代刑事法律制度產生變化的原因以及這種變化對宋代及后世的影響。五代刑事法律制度變化的原因,除了社會政治經濟形勢這一根本因素之外,也與因其存續(xù)歷史較短因而受唐中后期法律制度的影響較大有關。五代刑事法律制度的變化尤其在刑罰制度上影響巨大：一方面五代在刑罰執(zhí)行上繼承唐中后期的做法,進一步擴大杖刑的適用范圍,對原有中國古代五刑體系中的笞、徒、流、死刑的適用造成了更大的沖擊,對宋代影響甚大。宋代在五代基礎上創(chuàng)折杖法,使原有的笞、杖、徒、流、死傳統(tǒng)五刑,逐步在刑罰的實際執(zhí)行中為臀杖、脊杖、徒刑、死刑五種刑罰所替代,最終導致舊五刑體系在宋代名存實亡。另一方面,五代廣泛運用配刑和將刺配入刑、公開大量使用“凌遲”手法行刑、同時恢復肉刑的做法,為宋代及后世所繼承發(fā)展,對中國封建社會后期的法制,造成了極其嚴重的影響,最終使得中國封建社會后期的刑罰日趨殘酷。結語部分對五代刑事法律制度給以簡單的總結。
[Abstract]:Evaluation of the five generation of the criminal legal system, from the Song Dynasty and continues today, at different times, people from different positions and angles of judgment, the conclusions are not the same.
