【摘要】：作為私力救濟形式之一,防衛(wèi)是刑法古老、基本的免責(zé)事由。《新加坡刑法典》對私人防衛(wèi)做了詳實規(guī)定。私人防衛(wèi)的性質(zhì),存在正當事由V.寬恕事由和否定犯罪要素V.積極抗辯之爭,其屬于正當事由、積極抗辯已是基本共識�！缎录悠滦谭ǖ洹穼⒎佬l(wèi)分為防衛(wèi)人身、防衛(wèi)財產(chǎn),并對二者的成立條件做出不同規(guī)定。防衛(wèi)人身的構(gòu)成要件包括侵害人身犯罪的存在、防衛(wèi)必要、防衛(wèi)適時、防衛(wèi)相當以及對防衛(wèi)相應(yīng)情境的合理相信。防衛(wèi)財產(chǎn)與防衛(wèi)人身的構(gòu)成條件相仿,但其與防衛(wèi)人身亦有顯著區(qū)別:其一,防衛(wèi)針對的犯罪是法定的,且其范圍狹窄,其二,防衛(wèi)可以造成死亡結(jié)果的,其針對的犯罪必然同時侵害了人身或供人生活的場所的法益�！缎录悠滦谭ǖ洹返乃饺朔佬l(wèi),規(guī)定詳實,分類明了,趨主觀化,但其主觀化進路面臨困境,應(yīng)予反思。
[Abstract]:As one of the forms of private relief, defense is an ancient criminal law, the basic reason for exemption. The Singapore Criminal Code makes detailed provisions on private defense. The nature of private defense, There is a dispute about the existence of the legitimate cause, the forgiveness of the cause of the crime, and the active defense, which belongs to the legitimate cause, and the positive defense is already the basic consensus. The Singapore Criminal Code divides the defense into the defense of the person and the defence of property. The constituent elements of defending the person include the existence of the crime against the person, the necessity of defense, and the timely defense. The composition of defence property is similar to that of defensive person, but it is also significantly different from that of defensive person: first, the crime against which defense is committed is legal, and its scope is narrow; second, If defence can result in death, the crime against which it is committed must at the same time infringe upon the legal interests of the person or the place where the person lives. The provisions of the Singapore Criminal Code on private defence are detailed, clear and subjective. However, its subjective approach faces difficulties and should be reconsidered.
