【摘要】："家庭"在中國(guó)文化脈絡(luò)里有關(guān)鍵性地位,不僅是社會(huì)秩序與國(guó)家組成的基礎(chǔ),更是人文精神的實(shí)踐與展現(xiàn)。但法律中心論者,往往認(rèn)為這是破壞法律公正性的落后思想,不見(jiàn)容于當(dāng)代法治社會(huì)。其中最受到關(guān)注卻也最具爭(zhēng)議性的即是儒家的"親隱"思想。然而,透過(guò)霍耐特的"承認(rèn)理論"可以了解到,其實(shí)"法律"只是作為"市民社會(huì)"身份認(rèn)同的原則,不能忽略人還有以"愛(ài)"作為連結(jié)的"家庭"關(guān)系之身份認(rèn)同。而以"愛(ài)"為原則的身份認(rèn)同是身為人的自然需求,也是建立完整人格不可或缺的一環(huán)。"親隱"的追求正是企圖重建以人倫為中心的身份認(rèn)同,以避免"法律"對(duì)人造成的物化。
[Abstract]:"Family" plays a key role in the context of Chinese culture. It is not only the foundation of social order and national formation, but also the practice and manifestation of humanistic spirit. Not to be seen in the contemporary society of the rule of law. Among them, the most concerned and controversial is the Confucian idea of "proverbial concealment". However, through Honet's "theory of recognition", one can see that, In fact, "law" is only a principle of "civil society" identity, and one cannot ignore the identity of human beings and the "family" relationship connected by "love", and the identity based on the principle of "love" is the natural need of being human. It is also an indispensable link to establish a complete personality. The pursuit of "pro-hidden" is an attempt to reconstruct the identity centered on human relations in order to avoid the materialization caused by "law" to human beings.
