【摘要】：圖書館館藏作品數(shù)字化是建設(shè)數(shù)字圖書館的重要環(huán)節(jié),而解決館藏作品數(shù)字化中涉及的版權(quán)問題是各國版權(quán)立法關(guān)注的焦點之一。歐盟現(xiàn)行版權(quán)法(及其改革過程中)對館藏作品數(shù)字化過程中的孤兒作品及絕版作品作了特殊規(guī)定,以尋求實現(xiàn)公眾和權(quán)利人之間的利益平衡,這為我國有關(guān)館藏作品數(shù)字化的著作權(quán)法改革提供了有益借鑒。
[Abstract]:The digitization of library collections is an important link in the construction of digital library. To solve the copyright problems involved in the digitization of library works is one of the focuses of copyright legislation in various countries. The current copyright law of the European Union (and its reform process) has made special provisions on orphan works and out-of-print works in the process of digitizing collections works. In order to achieve the balance of interests between the public and the right holders, this paper provides a useful reference for the reform of copyright law concerning the digitization of library works in our country.
