當代中國法治建設中的孝道精神

【摘要】:孝道是我國古代社會極為顯著、重要的文化特質。近代以來社會的巨大變革雖然使得我國社會的方方面面發(fā)生了翻天覆地的變化,但是孝道精神仍將在我國長久地存在并持續(xù)地發(fā)揮作用。孝道精神存續(xù)的社會前提是家庭的存在,中國的文化傳統(tǒng)則為其存續(xù)提供了強大的文化—心理基礎,人自身安生立命的需要及其對超越向度的追求則是其存續(xù)的精神根源。孝道精神仍是當代中國法治建設的重要文化背景。 我國古代的孝道精神包含孝敬(孝順、孝祭)、孝養(yǎng)(養(yǎng)身、養(yǎng)心、養(yǎng)志)等豐富的內涵,具有倫理、社會—政治、宗教超越等復雜的多維向度。這種豐富內容、多維向度所形成的孝道精神使其成為我國古代社會中具有極為重要地位的“意識形態(tài)”。中國古代法律文化傳統(tǒng)作為整個古代社會的構成部分,同樣深受孝道精神的型塑、影響。從孝道精神與法律表征的關系模式來看,呈現(xiàn)出“孝統(tǒng)于法”的整體格局,孝道精神具有對于法律的統(tǒng)御地位,亦即孝道精神乃是更為根本的價值判準、政治元德、行為規(guī)范;從孝道精神在法律中表征的內容、形式來看,,表現(xiàn)出全面規(guī)制的形態(tài),法律不僅規(guī)定了子女對父母物質上的奉養(yǎng)義務,而且規(guī)定了子女對父母精神上的孝敬義務,不僅規(guī)范子女的外在行為,而且規(guī)范子女的內在心理、情感;從孝道精神在法律中表征的規(guī)范性質來看,局限于科予義務的規(guī)范性質。 當代中國法治建設中的孝道精神既是存續(xù)至今的孝道精神在法律方面的反映、體現(xiàn),也是我國現(xiàn)行法治建設對我國古代法律文化相應傳統(tǒng)的吸收、繼承,孝道精神在社會生活中的延續(xù)并繼續(xù)發(fā)揮作用乃是其在法律上的得到反映、表征影響的社會基礎,中國古代法律文化傳統(tǒng)則影響了我國現(xiàn)行法律體系中孝道精神的表現(xiàn)形式,二者是社會內容與法律形式的統(tǒng)一,互為表里。 當代強調對人的尊嚴予以平等尊重的時代精神使得我國古代孝道精神中所蘊含的愚孝等歪曲人性、扭曲人格、蔑視人的尊嚴、否定人的獨立價值的因素必須予以拋棄,并以發(fā)現(xiàn)和尊重人性、重視人的價值、注重人格的完整和充分的自我發(fā)展以及崇尚和尊重人的尊嚴為根本精神旨趣對其予以變革,這種孝道精神可以經(jīng)由恕道而實現(xiàn)其當代轉換。同時,當代中國孝道精神的法律表征從其整體關系模式上應從“孝統(tǒng)于法”向“孝融于法”實現(xiàn)轉換;作為當代中國孝道精神法律表征內容的成年子女贍養(yǎng)父母的法律義務因其對個人財產(chǎn)權的合理限制而具有某種社會意義,而家庭養(yǎng)老保障制度以及容隱制度則維護了家庭秩序,使得個人與國家之間保持了必要的距離而具有了某種政治意義、民主意蘊。 當代中國孝道精神的轉換及其法律表征的型塑乃是當代中國家庭秩序建構的重要組成部分,甚至具有了超出家庭秩序范圍的社會—政治維度,因而是我國社會主義法治建設中的重要內容和環(huán)節(jié)。
[Abstract]:Filial piety is the society of ancient China is extremely significant, important cultural characteristics. Since the modern society's huge transformation makes our society party had turn the world upside down changes, but the spirit of filial piety in China will still exist for a long time and continue to play a role. The existence of the spirit of filial piety is the premise of social family, China culture provides a strong foundation for the cultural psychology of its existence, people need their everyday and transcendence to the pursuit is the spiritual origin of its existence. The spirit of filial piety is still the important cultural background of contemporary China law construction.
The ancient Chinese filial piety, filial piety (including filial piety, filial piety, filial piety (offering) self-cultivation, Yangxin, keep records) etc. the rich connotation, has the ethical, social, political, religious transcendence and other complex multi-dimensional. This rich content, to the spirit of filial piety multidimensional form make it become a very the important position of the "ideology" of the ancient society of China. A model from the filial piety and legal representation, showing the overall pattern of traditional filial piety in law ", the law has the spirit of filial piety the domination, that is filial piety spirit is more fundamental value criteria, political traditionalethics, behavior norms; form from filial piety spirit in the legal representation in content, showing a comprehensive regulation form, not only the legal provisions of the children The parents on the material support obligations, and provisions of the children of parents filial obligation spirit, not only regulate the external behavior of their children, and their children's inner psychological norms, from the normative nature of emotion; filial piety spirit in the legal characterization, properties of the obligation to the limited to the specification.
Reflect the spirit of contemporary filial piety, filial piety in the China rule of law spirit is not only exists to this day in the aspect of law embodied, but also the construction of the rule of law in China corresponding to the tradition of ancient Chinese legal culture absorption, inheritance, continuation of filial piety in social life and continue to play a role in the law is reflected in society the basic characterization of the influence of traditional legal culture in ancient Chinese affects the form of filial piety in China's current legal system, the two are unified, social content form and legal life.
The contemporary emphasis on human dignity to equal respect for the spirit of the times which contains filial piety spirit in ancient China in the filial piety and distort the humanity, distorted personality, contempt for human dignity, the independent value of negative factors must be abandoned, and to discover and respect for humanity, emphasis on human values, pay attention to personal integrity and full self development and respect and respect for human dignity as the fundamental spirit of reformation of the spirit of filial piety, this can be achieved through forgiveness and the contemporary transformation. The transformation of filial piety in contemporary China and the shaping of its legal representation are important components of the construction of family order in contemporary China, and even have a social political dimension beyond the family order.
