【摘要】：自古人類就有逐水草而居的習(xí)慣,隨著科技社會的發(fā)展,交通條件越來越方便,人口遷徙則在更大的時空里發(fā)生著,隨著國家出現(xiàn),國家主權(quán)獨立意識覺醒,各國加強對于本國的移民管理,于是出現(xiàn)了合法移民和非法移民之分,非法移民也是人口遷徙的一種形式,不過這種形式違背法律,給社會和國家都帶了不小的危害,因此需要法律的規(guī)制,美國作為“移民之國”,其境內(nèi)的非法移民困擾也由來之久,對于非法移民的法律規(guī)制,美國形成了自己的一套體制,頒布了一系列的法律法規(guī),中國過去在這個問題上一直是作為非法移民輸出國而存在,隨著中國經(jīng)濟的快速發(fā)展,中國也吸引著各方外籍人士入境中國,中國在規(guī)制非法移民問題上也制定了自己的法律法規(guī),對于中美兩國在規(guī)制非法移民問題上的法律政策的分析比較研究,有利于發(fā)現(xiàn)自己的優(yōu)點和長處,同時也能找出不足之處,吸取對方在處理非法移民上的積極的經(jīng)驗以及教訓(xùn),所謂取其精華去其糟粕,對于我國更好地處理這一問題,發(fā)展我國現(xiàn)代化建設(shè)具有十分重要的意義。本課題研究的創(chuàng)新點有：1.對于中國境內(nèi)外國非法移民的關(guān)注。對于我國非法移民的研究長期以來主要集中在我國作為非法移民輸出國的方面,但是隨著我國綜合國力的提高,我國對周邊國家產(chǎn)生了吸引力,成為非法移民輸入國,本文中對于入境中國的非法移民按照來源地不同,分別對這些非法移民進行了論述。2.對于兩國非法移民政策的多角度分析。本文從不同的角度對于中美非法移民從產(chǎn)生背景、規(guī)制的具體措施以及效果都進行了相關(guān)的研究；3.美國移民政策對于我國的啟發(fā)意義。對于中美兩國非法移民政策的研究,我國在日后對于非法移民的治理可以從中吸取很多經(jīng)驗為我所用,在制度的制定的原則和出發(fā)點上應(yīng)當(dāng)以我國的國家主權(quán)為原則,以我國的國情為出發(fā)點,也可以在實踐上吸收一些有利于我國的可行的具體制度。
[Abstract]:With the development of science and technology society, traffic conditions become more and more convenient, population migration takes place in a larger space and time, with the emergence of the country, the consciousness of national sovereignty and independence is awakened. States have strengthened their immigration management, which has led to the emergence of a distinction between legal and illegal migration, which is also a form of population migration, but which is contrary to the law. As a country of immigrants, the United States, as a country of immigration, has been troubled by illegal immigrants for a long time, the legal regulation of illegal immigrants. The United States has formed its own system and promulgated a series of laws and regulations. China used to exist as an exporter of illegal immigrants on this issue, along with the rapid development of the Chinese economy. China has also attracted foreigners from all over the world to enter China, and China has also formulated its own laws and regulations on the issue of illegal immigration. The comparative study on the legal policies of China and the United States on the issue of illegal immigration is made. Help to find their strengths and strengths, but also find out the shortcomings of the other side in dealing with illegal immigrants in the positive experience and lessons, the so-called take the essence of its dregs. For my country, this issue is better addressed. It is of great significance to develop the modernization of our country. 1. Concern for foreign illegal immigrants in China. The study of illegal immigration in China has been mainly focused on China as an exporter of illegal immigrants for a long time. However, with the improvement of China's comprehensive national strength, China has become an attractive country to neighboring countries and has become an importing country of illegal immigrants. In this paper, the illegal immigrants entering China are different according to their origin. This paper discusses these illegal immigrants respectively. 2. It analyzes the two countries' illegal immigration policies from different angles. This article from different angles from the background of the emergence of illegal immigrants in China and the United States. The specific measures and effects of regulation have been studied. 3.The enlightening significance of American immigration policy to our country. For the study of illegal immigration policy between China and the United States, our country can draw a lot of experience from it in the future. In the principle and starting point of system formulation, we should regard our country's national sovereignty as the principle, take our country's national conditions as the starting point, and absorb some practical and feasible systems in practice.
