【摘要】：蒙古法制史的研究離不開蒙古法制文獻(xiàn)的研究。蒙古族歷史上形成的蒙古法制文獻(xiàn)版本珍貴、內(nèi)容豐富、文字獨(dú)特。本文的主要研究對象清代察哈爾正鑲白旗《察罕烏拉寺寺規(guī)》是內(nèi)蒙古古代寺廟文獻(xiàn)中保存較完整的一部蒙古文宗教法規(guī)文獻(xiàn)。該文獻(xiàn)對清代內(nèi)蒙古地區(qū)喇嘛教戒律、宗教法規(guī)、蒙古族民間法律習(xí)俗和寺院經(jīng)濟(jì)管理制度的研究彌足珍貴,是一部珍貴的民族志史料。《察罕烏拉寺寺規(guī)》是專門記載寺廟規(guī)章制度和廟倉管理方面的文獻(xiàn),其中不乏記錄了十八世紀(jì)察哈爾八旗蒙古社會經(jīng)濟(jì)、人文、宗教信仰生活領(lǐng)域的諸多現(xiàn)象。本文依據(jù)蒙古文一手資料,結(jié)合前人研究和相關(guān)文獻(xiàn)史料,從文本解讀、文獻(xiàn)所反映的法律制度、法律淵源和史料價值三方面對《察罕烏拉寺寺規(guī)》進(jìn)行了初步研究,主要突出了其宗教法規(guī)文獻(xiàn)的特點(diǎn),并對其做了較全面系統(tǒng)的考察。
[Abstract]:The study of Mongolian legal history can not be separated from the study of Mongolian legal literature. Mongolian legal literature formed in the history of Mongolia is precious and rich in content. The main research object of this paper, Chahar Zhengxianbai Banner, is a relatively complete document of Mongolian religious laws and regulations preserved in ancient temple documents of Inner Mongolia. This document is related to Inner Mongolia in Qing Dynasty. The precepts of regional Lamaism. The study of religious laws and regulations, Mongolian folk laws and customs and monastery economic management system is very valuable. Is a precious annals of history. "Chahanula Temple rules" is a special record of the temple rules and regulations and temple warehouse management documents, including many records of 18th century Chahar Baqi Mongolian social economy, humanities. According to the Mongolian primary materials, combined with previous research and related documents historical data, from the text interpretation, the legal system reflected in the literature. This paper makes a preliminary study on the rules of the Chahanula Temple from three aspects of the origin of law and the value of historical materials, which mainly highlights the characteristics of its religious laws and regulations, and makes a comprehensive and systematic investigation of them.
