董仲舒法律思想研究

【摘要】:董仲舒及其政治法律思想在整個(gè)中國(guó)法律思想史上占有重要地位。其思想體系是以儒家思想為基礎(chǔ),吸收了黃老道家、法、墨、陰陽(yáng)五行家等學(xué)派思想精華而構(gòu)成的。董仲舒法律思想的形成,標(biāo)志著中國(guó)古代正統(tǒng)法律思想的確立。因此,系統(tǒng)研究董仲舒法律思想產(chǎn)生的歷史背景、理論淵源及其基本內(nèi)容對(duì)準(zhǔn)確理解我國(guó)封建正統(tǒng)法律思想有十分重要的意義。本文在闡述董仲舒法律思想的理論淵源及其主要法律思想的前提下,重點(diǎn)探討了董仲舒對(duì)中國(guó)古代法律思想儒家化的作用和“引經(jīng)決獄”司法實(shí)踐對(duì)中國(guó)古代法制及其發(fā)展的影響,以及以董仲舒“引經(jīng)決獄”為開端的中國(guó)古代的法制改革對(duì)現(xiàn)代法制建設(shè)的借鑒意義。另外,對(duì)于“引經(jīng)決獄”的核心部分——“原心論罪”都做了一些粗淺的闡述,從而使我們更清楚地認(rèn)識(shí)董仲舒法律思想的價(jià)值。 論文共分四部分。第一部分“董仲舒主要法律思想及其淵源”分為二個(gè)小部分。本人首先對(duì)董仲舒及其主要成就做了簡(jiǎn)要的概括,接下來簡(jiǎn)單介紹了董仲舒法律思想的主要內(nèi)容。第二小部分對(duì)董仲舒的思想淵源進(jìn)行了梳理,分析了其思想的淵源和發(fā)展脈絡(luò):以先秦儒家思想為基礎(chǔ),對(duì)黃老道家、法家、陰陽(yáng)家、墨家等諸子百家思想進(jìn)行了吸收與融合,得出了董仲舒的思想是在先秦儒家學(xué)說的基礎(chǔ)上,借鑒和吸收了諸子百家主張的結(jié)論。董仲舒的新儒家思想是繼孔、孟、荀之后儒家思想的第二次重新組合,奠定了封建正統(tǒng)法律思想的理論基礎(chǔ)。論文的第二部分“董仲舒與法律思想的儒家化”共分為二個(gè)小部分,論文首先從四個(gè)方面討論了中國(guó)古代法律思想儒家化的原因。然后,介紹了董仲舒推動(dòng)法律思想儒家化的途徑:建立起一套以儒家思想為指導(dǎo)的法律思想體系,并通過推動(dòng)儒學(xué)獨(dú)尊來促進(jìn)其法律思想的傳播,推動(dòng)法律思想儒家化。論文的第三部分“董仲舒與《春秋》決獄”分二個(gè)小部分,首先討論了董仲舒所倡導(dǎo)的“春秋決獄”及其表現(xiàn),接下來重點(diǎn)分析了《春秋》決獄的核心“原心論罪”,在第二小部分又對(duì)《春秋》決獄的利弊進(jìn)行了分析。論文的第四部分“董仲舒的法律思想評(píng)析”對(duì)董仲舒法律思想的影響、作用及其現(xiàn)代借鑒意義進(jìn)行了評(píng)析。筆者首先肯定了董仲舒法律思想在歷史上的積極作用,又簡(jiǎn)單分析了其思想的負(fù)面影響,最后討論了董仲舒法律思想對(duì)現(xiàn)代法治建設(shè)的借鑒和啟示作用。 本文的寫作目的在于:通過探尋董仲舒法律思想的淵源,找出其主要法律思想及其與諸子百家思想之間的繼承和發(fā)展關(guān)系,通過對(duì)法律思想儒家化、“引經(jīng)決獄”和“原心論罪”的分析,從而對(duì)董仲舒法律思想做出比較客觀、準(zhǔn)確的認(rèn)識(shí)和評(píng)價(jià)。并通過這些研究,更希望找到一些漢代以法律儒家化為內(nèi)容的法制改革過程中的經(jīng)驗(yàn)教訓(xùn),以期為現(xiàn)代的法制改革提供一些可供借鑒的經(jīng)驗(yàn),這也是本文的寫作價(jià)值所在。
[Abstract]:Dong Zhongshu and his political and legal thought occupies an important position in the history of legal thought. China its ideology is based on the Confucianism, the absorption of Huang Lao, method, ink, etc. the essence of Yin Yang and five expert school formed. The formation of Dong Zhongshu's legal thoughts, marks the establishment of the orthodox legal thought of ancient China. Therefore study on the system, historical background of Dong Zhongshu's legal thoughts, theoretical origin and basic content is very important to understand the China's feudal orthodox legal thought. The article is based on the theoretical origin of Dong Zhongshu's legal thoughts and expounds main legal thoughts, focusing on the effect of Dong Zhongshu on the Chinese ancient legal thought of Confucianism and "Yin the effect of trial by the judicial practice of Chinese ancient legal system and its development, as well as Dong Zhongshu" cited by statute "as the beginning of the Chinese ancient law Reference system reform of modern legal system construction. In addition, the "cited by the core part of history" -- the "original heart on" have done some preliminary exploration, so that we can more clearly understand the value of Dong Zhongshu's legal thought.
This paper is divided into four parts. The first part of the "thought and origin of" Dong Zhongshu law is mainly divided into two small parts. First I on Dong Zhongshu and his main achievements were briefly outlined, followed by a brief introduction of the main contents of Dong Zhongshu's legal thought. In the second part, the thought origin of Dong Zhongshu carried out and analyzes the origin and development of train of thought: the pre Qin Confucianism based on Huang Lao Taoism, Legalism, yin and Yang, Mohist Thought of all classes of authors of absorption and fusion, that Dong Zhongshu's thought is based on the Confucian doctrine, and to draw the conclusion that all classes of authors. Dong Zhongshu's new Confucianism is the second hole. Meng Xun, after the second Confucianism re combination, laid the theoretical foundation of the feudal orthodox legal thought. The second part of "Dong Zhongshu and the Confucian Legal Thought "The total is divided into two parts, firstly from four aspects discussed the reasons of the ancient Confucian legal thought Chinese. Then, introduces the way of promoting the legal thoughts of Dong Zhongshu: to establish a set of Confucianism as the guidance system of legal thoughts, and by promoting Confucianism to promote the spread of its legal thought the legal thoughts of Confucianism. To promote the third part of" Dong Zhongshu "in spring and autumn >" divided into two parts, first discusses Dong Zhongshu advocated "judging" and its performance, then analyzed the "core" spring and autumn > never imprisoned the original heart he ", is analyzed in the second part the < > in spring and autumn. Effects of the advantages and disadvantages of the fourth part of" evaluation "of Dong Zhongshu's legal thoughts on the legal thought of Dong Zhongshu, and modern significance are analyzed. The author first affirmed the Dong The positive role of Zhong Shu's legal thought in history has simply analyzed the negative influence of his thought. At last, I have discussed Dong Zhongshu's legal thought for reference and inspiration to modern rule of law construction.
The purpose of this paper is to explore the origin of Dong Zhongshu's legal thoughts, to find out the main legal thought and the inheritance and development of relations with all classes of authors between ideas, based on the legal thought of Confucianism, "cited by the analysis of history" and "the original heart", and the legal thought of Dong Zhongshu to make more objective and accurate understanding and evaluation. And through these research, hoping to find some more in the Han Dynasty Confucian legal experience of legal reform process in content, in order to provide some experience for reference of modern legal reform, this is also the value of writing.
