【摘要】：法學(xué)研究有基礎(chǔ)研究和對(duì)策研究?jī)煞N,研究成果的直接服務(wù)目標(biāo)也有法學(xué)知識(shí)擴(kuò)展與回應(yīng)國(guó)家重大緊迫法治實(shí)踐難題之分野。法學(xué)智庫(kù)研究的學(xué)術(shù)使命主要在于:推進(jìn)社科法學(xué)研究的轉(zhuǎn)型、在國(guó)家重大決策中發(fā)揮法律類(lèi)智庫(kù)的專(zhuān)業(yè)性資政作用;順應(yīng)世界政治發(fā)展日趨民主化潮流,為黨和政府依法、科學(xué)、民主決策提供更加堅(jiān)實(shí)的科學(xué)依據(jù)、知識(shí)基礎(chǔ)和思想支持;促進(jìn)國(guó)家治理盡快邁向現(xiàn)代化。法學(xué)智庫(kù)以服務(wù)于國(guó)家智庫(kù)建設(shè)、為國(guó)家重大決策提供咨詢(xún)服務(wù)為目標(biāo)。法學(xué)智庫(kù)研究應(yīng)當(dāng)堅(jiān)持的原則包括:學(xué)理性與實(shí)踐性的結(jié)合,偏重實(shí)踐性;科學(xué)性與政策性的結(jié)合,偏重科學(xué)性;多學(xué)科交叉研究與法學(xué)研究相結(jié)合,堅(jiān)持法學(xué)為中心;堅(jiān)持戰(zhàn)略性、超前性、創(chuàng)新性與國(guó)際視野。法學(xué)智庫(kù)研究中,必須避免的"無(wú)需理論"、"割裂學(xué)術(shù)傳統(tǒng)"、"完全價(jià)值中立"、"任何復(fù)雜法治現(xiàn)實(shí)問(wèn)題都可以納入法學(xué)智庫(kù)研究視野"四種認(rèn)識(shí)誤區(qū)。
[Abstract]:There are two kinds of legal research: basic research and countermeasure study. The direct service goal of the research results also has the distinction between expanding the legal knowledge and responding to the important urgent legal practice problems of the country. The academic mission of the legal think-tank research is mainly to promote the transformation of the social science law research. To give play to the professional role of the legal think tank in the major national decision-making; In keeping with the trend of democratization in the world's political development, it provides a more solid scientific basis, knowledge basis and ideological support for the Party and the government in accordance with the law, science and democratic decision-making; To promote national governance towards modernization as soon as possible. Legal think tanks to serve the construction of national think tanks. The research of legal think-tank should adhere to the following principles: the combination of academic rationality and practice, and the emphasis on practicality; The combination of science and policy emphasizes science; The combination of interdisciplinary research and legal research, insisting on the center of law; Adhere to the strategic, forward, innovative and international perspective. In the research of legal think tank, we must avoid "no theory", "split academic tradition" and "complete value neutrality". Any complicated practical problems of rule of law can be brought into the field of view of legal think-tank.
