【摘要】：美國在其《外國主權豁免法》中創(chuàng)設了一項新的國家豁免——"恐怖主義例外",允許恐怖主義受害者及其家屬在美國聯(lián)邦法院直接起訴"恐怖主義資助國"以獲得民事賠償。在國內法層面,該項國家豁免例外為恐怖主義受害者及其家屬提供了追究"恐怖主義資助國"責任的法律途徑;在國際法層面,其作為一國的反恐單邊措施,勢必影響其他國家的國家行為和責任承擔,且可能因當前打擊國際恐怖主義的需求而被更多的國家認可和效法,值得加以關注。
[Abstract]:The United States created a new State immunity in its Foreign Sovereign Immunities Act-the "terrorism exception". Allow victims of terrorism and their families to prosecute "terrorist financiers" directly in United States federal courts for civil compensation... at the domestic law level. This State exemption provides an exceptional legal avenue for the victims of terrorism and their families to hold "terrorist financing States" accountable; At the level of international law, unilateral measures against terrorism as a country will inevitably affect the behavior and responsibility of other countries, and may be recognized and emulated by more countries because of the current need to combat international terrorism. It deserves attention.
