【摘要】:每一種社會(huì)的法理學(xué)的發(fā)展和演進(jìn)過(guò)程,必然與當(dāng)時(shí)社會(huì)的社會(huì)法律生活、學(xué)術(shù)思想觀念與理論以及當(dāng)時(shí)的國(guó)家法律制度的發(fā)展?fàn)顩r有關(guān)。學(xué)界對(duì)中國(guó)古代社會(huì)是否存在法理學(xué)有肯定論和否定論之爭(zhēng)?隙ㄕ撜哒J(rèn)為在中國(guó)古代社會(huì)不僅存在法理學(xué),而且認(rèn)為其體系完善,內(nèi)容豐富。最好的明證便是在唐朝時(shí)期匯集《新律》、《晉律》、《北齊律》和《開(kāi)皇律》等諸多成文法律典的《唐律疏議》的出現(xiàn)。《唐律疏議》是中國(guó)古代社會(huì)“禮治”與“法治”相互融合,包含儒家、法家、墨家、陰陽(yáng)家等各學(xué)派思想的成文法法典,同時(shí)也包括刑法和法理學(xué)的一部綜合性法典。否定論者則認(rèn)為中國(guó)古代的法理學(xué)的概念只是后世學(xué)者對(duì)西方法理學(xué)比附的結(jié)果,因?yàn)樵谥袊?guó)古代社會(huì)并沒(méi)有形成法理學(xué)的體系和結(jié)構(gòu)。在筆者看來(lái),肯定論和否定論都有自己的合理之處卻又都不夠全面。中國(guó)古代社會(huì)法理學(xué)起步很早,在注釋學(xué)的發(fā)展上也取得了較大的發(fā)展,中華法系也是世界法系中獨(dú)立偉大的法系之一,雖然中國(guó)古代社會(huì)法理學(xué)在體系和結(jié)構(gòu)上不夠全面,但是存在法理學(xué)卻是不爭(zhēng)的事實(shí)。 本文通過(guò)對(duì)中國(guó)古代社會(huì)的春秋戰(zhàn)國(guó)時(shí)期、秦漢時(shí)期、魏晉南北朝時(shí)期、隋唐時(shí)期四個(gè)時(shí)期中的法理學(xué)的發(fā)展與演進(jìn),闡述了這四個(gè)時(shí)期國(guó)家注釋學(xué)的發(fā)展、法的起源、成文法法典的編撰以及以儒家思想和法家思想為代表的各家學(xué)派的思想對(duì)當(dāng)時(shí)法理學(xué)的滲透與影響,論證了中國(guó)古代社會(huì)法理學(xué)的發(fā)展與演進(jìn),從而得出了中國(guó)古代社會(huì)確實(shí)存在法理學(xué),并且它隨著歷史的發(fā)展而不斷的發(fā)展和充實(shí)“自我”的結(jié)論。 法理學(xué)被界定為是法律的智慧,中國(guó)古代社會(huì)的法理學(xué)更是承著中國(guó)古人的“優(yōu)秀”的法律成果和法律文化。了解并認(rèn)識(shí)中國(guó)古代社會(huì)的法理學(xué)更是認(rèn)知當(dāng)今世界法理學(xué)發(fā)展和變化的基礎(chǔ)。
[Abstract]:The development and evolution of jurisprudence in each society is bound to be related to the social and legal life of the society at that time. Academic ideas are related to the development of theory and the legal system of the country at that time. There is a debate between scholars about the existence of jurisprudence in ancient Chinese society. Affirmative theorists believe that in ancient Chinese society not only. There is jurisprudence. The best evidence is the collection of "New Law" and "Jin Law" in the Tang Dynasty. The appearance of "Tang Law" and "the Law of the Emperor", and so on. The "rule of etiquette" and "rule of law" in ancient Chinese society are combined together, including Confucianism, legalists, and Mohist schools. The statutory code of various schools of thought such as Yin and Yang. At the same time, it also includes a comprehensive code of criminal law and jurisprudence. The negative theorists think that the concept of jurisprudence in ancient China is only the result of the comparison of western jurisprudence by later scholars. Because in the ancient Chinese society there was no legal system and structure. In the author's opinion, both positivism and negation have their own rationality, but they are not comprehensive enough. The jurisprudence of ancient Chinese society started early. Great progress has been made in the development of hermeneutics. The Chinese legal system is also one of the independent and great legal systems in the world law system, although the jurisprudence of ancient Chinese society is not comprehensive in system and structure. But the existence of jurisprudence is an indisputable fact. Through the development and evolution of jurisprudence in the Spring, Autumn and warring States, Qin and Han dynasties, Wei, Jin, Southern and Northern dynasties and Sui and Tang dynasties in ancient China, this paper expounds the development of national annotation in these four periods. The origin of law, the compilation of statutory code and the infiltration and influence of various schools of thought, represented by Confucianism and Legalism, on jurisprudence at that time, demonstrated the development and evolution of jurisprudence in ancient Chinese society. The conclusion is that jurisprudence does exist in ancient Chinese society, and it develops and enriches "self" with the development of history. Jurisprudence is defined as the wisdom of law. The jurisprudence of ancient Chinese society inherits the "outstanding" legal achievements and legal culture of the ancient Chinese people, and understanding and understanding the jurisprudence of the ancient Chinese society is the basis of understanding the development and changes of jurisprudence in the world today.
