【摘要】：關(guān)于中國(guó)法律的"東方主義"認(rèn)知是一種對(duì)中國(guó)治理模式非常系統(tǒng)化的誤讀,一種根深蒂固的情緒化偏見。它提醒我們警惕這樣一種長(zhǎng)期以來(lái)存在、也將繼續(xù)長(zhǎng)期存在的現(xiàn)象:因?yàn)橛^察和研究的感情化,使得人們對(duì)于中國(guó)治理模式(包括中國(guó)法律體系)的了解和理解常常處在一種盲人摸象的褊狹狀態(tài),即簡(jiǎn)單化地用"無(wú)法""反法"或者"超法"來(lái)概括中國(guó)的法律制度實(shí)踐,而無(wú)視"有法"才是中國(guó)社會(huì)治理的基本形態(tài)。法律的"東方主義"不僅僅在知識(shí)上讓我們誤讀了中國(guó),也在政策上誤導(dǎo)了中外的政治家。本文呼吁理性對(duì)待中國(guó)法律制度實(shí)踐中無(wú)法、有法、反法與超法四種現(xiàn)象共存的狀態(tài)。
[Abstract]:The "Orientalism" cognition about Chinese law is a kind of systematic misreading of Chinese governance model, a kind of deep-rooted emotional prejudice, which reminds us to guard against such a long-standing existence. It will also continue to exist for a long time: because of the emotionalization of observation and research, people's understanding and understanding of China's governance model (including the Chinese legal system) is often in a narrow state of blind people's feeling. That is to say, it is simple to generalize the practice of China's legal system by "unable" and "anti-law" or "super-law". Ignoring the "law" is the basic form of Chinese social governance. The "Orientalism" of law not only makes us misread China in knowledge. It also misleads Chinese and foreign politicians in policy. This paper calls for a rational treatment of the coexistence of four phenomena in the practice of China's legal system, namely, the inability, the existence of law, the opposition to law, and the transcendence of law.
