【摘要】：法律發(fā)展是法理學研究的一個重要領域，本文擬對法律發(fā)展動力進行初步的探索。社會發(fā)展需要有動力，有動力才能有發(fā)展，沒有動力社會就不能獲得發(fā)展。法律發(fā)展是伴隨著社會的發(fā)展而發(fā)展。法律發(fā)展在本質(zhì)上是社會發(fā)展的反映，隨著人類社會進步性變化而發(fā)展。法律發(fā)展動力雖然根源于社會發(fā)展的動力，但并不能完全用社會發(fā)展動力的學說解釋法律發(fā)展。 本文先考察法律發(fā)展概念的形成和內(nèi)涵，然后界定確定法律發(fā)展動力的概念及其內(nèi)涵，進而分析法律發(fā)展動力的三種類型。在文章最后，，結合我國實際，探討時代背景下中國的法律發(fā)展動力，以此促進中國法律發(fā)展，建設有中國特色的社會主義法治國家。
[Abstract]:The development of law is an important field of jurisprudence. This paper intends to explore the motive force of legal development. The development of law is accompanied by the development of society. In essence, the development of law is the reflection of social development. Although the motive force of legal development is rooted in the motive force of social development, it can not completely explain the development of law with the theory of motive force of social development. This paper first examines the formation and connotation of the concept of legal development, then defines the definition and connotation of the power of legal development, and then analyzes the three types of driving force of legal development. At the end of the article, combined with the reality of our country. This paper probes into the power of legal development in China under the background of the times in order to promote the development of Chinese law and to build a socialist country ruled by law with Chinese characteristics.
