【摘要】：作為理學(xué)家的劉后村,他的思想淵源眾多,不僅吸取了儒家孔孟思想的精華,而且也融合了道家、法家等諸多學(xué)派的思想學(xué)說,更是繼承了理學(xué)大家朱熹的思想。在他為政為官的數(shù)十年中,劉后村積極參與法律實踐,他的法律思想以書判的形式幸存后世。書判是中國古代裁決獄訟的法律文書,本文以《名公書判清明集》和《后村先生大全集》中收集的劉后村生平所作的判文為研究對象,探討書判中所反映的南宋時期劉后村法律思想。緒論部分主要回顧了宋代士大夫、理學(xué)家、書判研究及劉后村思想研究四方面的學(xué)術(shù)史及研究現(xiàn)狀;接下來第二章則考察劉后村生平、法律實踐和書判著述;第三章論述了劉后村的天理倫理法律觀,從家庭血緣倫理和義理決獄兩方面探討劉后村的理學(xué)法律思想;第四章論述了劉后村的司法審判中士大夫的自覺精神、法與情理一體、注重客觀理性、以民為本和嚴刑恤刑思想;第五章以劉后村在審判中所體現(xiàn)的息訟思想為研究對像,分別論述了他的教化思想、調(diào)解思想、生養(yǎng)思想及懲戒思想三方面,從中可以看出宋理學(xué)家法律思想在司法實踐中的具體展現(xiàn);最后結(jié)語部分對全文進行簡要總結(jié),并再次論述后村書判中法律思想及后村的理學(xué)思想。
[Abstract]:As a philosopher Liu Hou Cun, source of many of his ideas, not only absorbed the essence of Confucianism of Kong Meng thought, but also combines Taoist, Legalist school and other theories is inherited Zhu Xi's thought of science. In all his political official decades, Liu Hou village actively participate in legal practice, form his legal thought to the survival of future generations. This book is a Book of ancient legal documents China sentenced the lawsuit verdict, taking the "compilation of just verdicts by famous judges" and "collected after Mr. 2lps village in Liu Hou Cun life > judgments made by the paper as the research object, to explore the legal thought reflected Liu Hou Cun in the book the Southern Song Dynasty. The introduction part mainly reviews the literati of Song Dynasty, Neo Confucianism, academic history and research status of the book to the four aspects of research and thinking of the next Liu Hou Cun Liu Hou Cun; the second chapter examines life, legal practice and Book Writing; third Chapter discusses the ethical and legal justice view of Liu Hou Cun Liu Hou Cun, science of legal thought from the family ethics and philosophy in two aspects; the fourth chapter discusses the consciousness of judicial scholar Liu Hou Cun, law and reasonable development, pay attention to the objective and rational, people-oriented and cruel punishment thought; in the fifth chapter, Liu Xisong thought embodied in the Hou Cun in the trial to study the like, discusses his educational thoughts, ideas and thoughts have mediation, disciplinary thought three aspects, can be seen from the Song Dynasty Neo Confucianism embodies legal thoughts in the judicial practice; finally, the conclusion part makes a brief summary of the full text, and again on the law after the court verdict in the village after village thought and Neo Confucianism.
