【摘要】：根據(jù)已有資料和最新搜集所得的資料,本文考證認(rèn)為;清末編訂民律草案是一個(gè)艱難而又曲折的過程,主要經(jīng)歷了"修訂法律權(quán)之爭(zhēng)"、"擬訂《編纂民法之理由》(草稿)與確定編纂計(jì)劃"、"開展民事調(diào)查與編訂民律草案‘條文稿'",以及"編訂《大清民律草案》‘說明稿'"。由于清末政治形勢(shì)日益緊迫,致使當(dāng)時(shí)的修訂法律館不可能按照既定的立法計(jì)劃進(jìn)行編訂,最終完成的《大清民律草案》也難免存在著一些嚴(yán)重的缺陷。
[Abstract]:According to the existing data and the collected data, this paper research that developed in the late Qing Dynasty; civil law draft is a difficult and tortuous process, mainly through the "revised law dispute" and "draft" compilation of civil law (Draft) "reason and determination of compiling plan, carry out the civil investigation and making people the draft law" provisions ", and" release 'compilation of "the draft law" draft "that'". The political situation is increasingly urgent, the amendments to the law library was impossible to compile in accordance with the legislative plan established, finally completed the "draft law" will inevitably exist some serious defects.
