【摘要】：《黃帝四經(jīng)》是黃老學(xué)的奠基之作,它提倡"道生法",在治道上將"法治"和"德治"融合起來(lái),提煉出"法主德輔"的治道精神�！饵S帝四經(jīng)》"法主德輔"的治道精神是理性的化身,終結(jié)了先秦的"禮法之爭(zhēng)",實(shí)現(xiàn)了治道的制衡�！饵S帝四經(jīng)》"法主德輔"的治道精神對(duì)戰(zhàn)國(guó)中后期中國(guó)治道精神的發(fā)展演變產(chǎn)生了重大影響,管子、慎子、荀子、韓非子等都在被影響之列。董子接續(xù)了荀子"德主法輔"的治道精神,并將這種治道精神轉(zhuǎn)化成治道實(shí)踐,成為中國(guó)封建時(shí)代主流的治道模式。但"德主法輔"只能適應(yīng)封建的農(nóng)業(yè)宗法社會(huì),于現(xiàn)代的商業(yè)社會(huì)不契合。所以,大力挖掘《黃帝四經(jīng)》"法主德輔"的治道精神,于當(dāng)下法治中國(guó)構(gòu)建"法主德輔"的治道模式是大有裨益的。
[Abstract]:"the four Classics of the Yellow Emperor" is the foundation of the Huang-Lao School. It advocates the "Taoism Law" and merges the "rule of law" with the "rule of virtue" in governing the way. Abstract the spirit of governing Tao in "Dharma, morality and aid". The spirit of "Dharma, moral and auxiliary" is the incarnation of reason in "the four Classics of the Yellow Emperor". It ended the "dispute of etiquette and law" in the pre-Qin Dynasty, and realized the balance of governing the Tao. The spirit of governing the Tao in "the four Classics of the Yellow Emperor" had a great influence on the development and evolution of the spirit of governing the Tao in China in the middle and late period of the warring States period. Han Feizi and so on are affected by the list. Dong Zi succeeded Xunzi's spirit of "virtue dominating law", and transformed this spirit into practice, and became the mainstream mode of ruling Tao in feudal times in China. But "virtue dominates the law auxiliary" can only adapt to the feudal agricultural patriarchal society, not in the modern commercial society. Therefore, it is of great benefit to excavate the spirit of governing Tao in "the four Classics of the Yellow Emperor", and to construct the mode of "ruling by law and virtue" in the present rule of law in China.
