【摘要】：強(qiáng)奸案的證據(jù)通常應(yīng)具備暴力證據(jù)和性交證據(jù),機(jī)械性損傷、使用藥物和生物檢材等是構(gòu)成暴力證據(jù)和性交證據(jù)的重要組成部分。由于加害人實(shí)施強(qiáng)奸時(shí)手段的不同以及個(gè)體性行為的差異,損傷的類型、形態(tài)、部位及生物檢材的種類、遺留部位、遺留客體也會(huì)呈現(xiàn)不同特征。如果不仔細(xì)地檢查和提取,就會(huì)使這些物證滅失。本文通過對(duì)120例強(qiáng)奸案件的分析,總結(jié)了案件中損傷、藥物、生物檢材的發(fā)現(xiàn)、提取和檢驗(yàn)的相關(guān)信息與技術(shù)細(xì)節(jié)問題,同時(shí)結(jié)合案情對(duì)案件發(fā)生的時(shí)段、地點(diǎn)、環(huán)境、區(qū)域、作案手段與方法、嫌疑人和受害人的職業(yè)特點(diǎn)等進(jìn)行了討論,希望對(duì)法醫(yī)學(xué)鑒定工作和民警辦理案件有所幫助。
[Abstract]:Evidence of rape should usually have evidence of violence and sexual intercourse, mechanical injury, use of drugs and biological materials are important components of evidence of violence and sexual intercourse.Because of the different means of rape and the difference of individual behavior, the types, forms, sites and biological materials of the injuries, the residual parts and the left objects will also show different characteristics.If not carefully checked and extracted, the material evidence will be lost.Based on the analysis of 120 rape cases, this paper summarizes the discovery of injuries, drugs, biological materials, relevant information and technical details of extraction and inspection, and at the same time combines the case with the time, place, environment and region of the case.The methods and methods of the crime, the professional characteristics of the suspects and the victims are discussed in the hope that it will be helpful to forensic medical identification and the handling of cases by the police.
