【摘要】：職業(yè)健康監(jiān)護(hù)是一項(xiàng)由《職業(yè)病防治法》強(qiáng)制用人單位執(zhí)行的監(jiān)護(hù)項(xiàng)目,并且是預(yù)防職業(yè)病發(fā)生的行之有效的手段。在監(jiān)護(hù)實(shí)踐過程中,需要以公共衛(wèi)生倫理學(xué)理論為指導(dǎo),探討如何平衡企業(yè)利益與勞動(dòng)者健康的關(guān)系,實(shí)現(xiàn)共贏。從勞動(dòng)者的個(gè)體權(quán)利、職業(yè)衛(wèi)生機(jī)構(gòu)對(duì)于個(gè)人信息的保護(hù)、職業(yè)病鑒定的公正性等方面,對(duì)職業(yè)衛(wèi)生的倫理問題進(jìn)行了探索。最后提出在實(shí)踐中,需要以遵循倫理準(zhǔn)則為基礎(chǔ),將保障勞動(dòng)者職業(yè)健康權(quán)益作為核心目標(biāo),構(gòu)建三方責(zé)任體系,加強(qiáng)勞動(dòng)者自身的維權(quán)意識(shí),落實(shí)國(guó)家對(duì)弱勢(shì)群體的保護(hù)策略并且構(gòu)建企業(yè)的社會(huì)責(zé)任評(píng)價(jià)體系。
[Abstract]:Occupational health monitoring is a monitoring project enforced by the employer under the Occupational Disease Prevention and Control Law, and it is an effective means to prevent occupational diseases.In the course of the practice of guardianship, it is necessary to discuss how to balance the relationship between the interests of enterprises and the health of workers under the guidance of the theory of public health ethics in order to achieve win-win situation.This paper probes into the ethical issues of occupational health from the aspects of the individual rights of workers, the protection of personal information by occupational health institutions and the impartiality of occupational disease identification.Finally, it is proposed that in practice, it is necessary to take the protection of workers' occupational health rights and interests as the core goal, to build a tripartite responsibility system, and to strengthen workers' awareness of protecting their rights and interests on the basis of following ethical norms.Implement the national protection strategy for the vulnerable groups and build the corporate social responsibility evaluation system.
