【摘要】：目的:明確醫(yī)院藥師應有的權利和義務,為我國藥師立法提供參考。方法:通過查閱《憲法》《處方管理辦法》等法律法規(guī),參照《執(zhí)業(yè)醫(yī)師法》《護士條例》及與之相關的文獻,闡述我國醫(yī)院藥師的權利和義務。結果:醫(yī)院藥師應當享有的權利,包括獲得工資報酬和津貼及福利待遇的權利、職業(yè)安全防護的權利、相關安全職業(yè)防護的權利、繼續(xù)教育和開展學術交流的權利,以及參與本單位藥品質量管理工作和對有質量問題的藥品實行否決權等。醫(yī)院藥師需要履行的義務,包括遵守法律、法規(guī)、規(guī)章,審核調配處方,指導患者合理用藥,保護患者隱私,某些情況下的注意警示等。結論:藥師的權利與義務是辨證統(tǒng)一的,并具有邏輯相關性和道德相關性。藥師的權利與義務必須通過立法行為,以法律手段實現(xiàn)。建議可在《執(zhí)業(yè)藥師資格暫行規(guī)定》的基礎上制訂新藥師法,遵循權利與義務對等的立法理念,并建立相應的監(jiān)督機制。
[Abstract]:Objective: to clarify the rights and obligations of hospital pharmacists and to provide reference for the legislation of pharmacists in China. Methods: by referring to the Constitution and other laws and regulations, referring to the Nurses regulations of the Medical Practitioners Law and the related documents, the rights and obligations of Chinese hospital pharmacists were expounded. Results: the rights that hospital pharmacists should enjoy, including the right to receive wages, remuneration and allowances and benefits, the right to occupational safety protection, the right to relevant safety occupational protection, the right to continue education and to conduct academic exchanges, As well as participating in the unit drug quality management and quality problems to implement the veto power and so on. Hospital pharmacists are required to comply with laws, regulations, review and dispensing prescriptions, guide patients to use drugs properly, protect patients' privacy, and, in some cases, caution. Conclusion: the rights and obligations of pharmacists are dialectical, and have logical and moral relevance. The rights and obligations of pharmacists must be realized through legislative actions and by legal means. It is suggested that the new drug teacher law should be formulated on the basis of the interim regulations on the qualification of licensed Pharmacists, follow the legislative concept of equal rights and obligations, and establish the corresponding supervision mechanism.
